ORDER:
This Criminal Petition is filed by the petitioners-Accused Nos.1 to 7 to quash the proceedings in DVC No.75 of 2025 on the file of IV Additional Judicial Magistrate of First Class at L.B. Nagar.
2. Heard Sri Rapolu Bhaskar, learned counsel for the petitioners and Sri Jithender Rao Veeramalla, learned Additional Public Prosecutor for the respondent No.1-State.
3. Learned counsel for the petitioners has submitted that the de facto complainant is bent upon harassing the petitioners herein and that though she has stayed only for two weeks at the matrimonial home, she has continued her harassment by filing one case after the other. He further submitted that inspite of filing the case under Section 498-A IPC, the present case under the provisions of Protection of Women from Domestic Violence Act, 2005 is also filed against the petitioners with a malafide intention. He relied upon the decision of the Hon’ble Apex Court in Dara Laxminarayana v. State of Telangana & another, 2024 INSC 953 and stated that the said case law applies to
the case on hand and therefore, prayed to quash the proceedings against the petitioners.
