HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.30924 OF 2025 ORDER : (ORAL)

This writ petition is filed by the petitioner seeking to declare the action of the respondent authorities in not acting upon his representation dated 20.09.2025 with regard to the illegal construction of ground + 5 upper floors undertaken by respondent No.6 in Plot No.1063, admeasuring 233 square yards in Survey No.45, Bhagat Singh Nagar, Phase-2, Hyder Nagar Village, Kukatpally, Medchal-Malkajgiri District, as being illegal, arbitrary and unconstitutional.

2. Heard Mr. Muthyala Muralidhar, learned counsel for the petitioner; Mr. K.Ravi Mahender, learned Standing Counsel for GHMC, appearing for respondents No.2 to 5; and perused the material on record.

3. Learned Standing Counsel for GHMC submitted that on complaint of the petitioner, the office records were verified and it was found that respondent No.6 obtained building permission vide file No.370645/1279/ GHMC/2024, dated 08.02.2024, for construction of stilt + 2 upper floors in the subject property. However, as against the building permission, respondent No.6 constructed stilt + 5 upper floors in deviation of the sanctioned plan. As such, show cause notice dated 29.03.2025 was issued to respondent No.6 calling upon her to submit explanation as to why the unauthorized construction should not be demolished. As no explanation/reply was submitted, speaking order dated 22.04.2025 was passed directing respondent No.6 to remove the unauthorized construction. Learned Standing Counsel submitted that further action pursuant to the speaking order dated 22.04.2025 will be taken as expeditiously as possible in accordance with law.

In the circumstances, this writ petition is disposed of directing respondents No.4 and 5 to implement the speaking order dated 22.04.2025 within a period of four (4) weeks from the date of receipt of a copy of this order. However, as 3rd, 4th and 5th floors are admittedly unauthorized, respondents No.4 and 5 are directed to forthwith seal the unauthorized floors.

5. Notice to respondent No.6 is dispensed with. However, if respondent No.6 is, in any way, aggrieved by this order, she is at liberty to approach this Court seeking for modification of this order.

There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in this writ petition, stand closed.
