ORDER:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief:

“…to issue a writ, order or direction more in the nature of Mandamus declaring the inaction of the Respondents particularly the 3rd Respondent herein with regard to registration of FIR and to take initiate necessary action against the Respondents 3 to 5 in spite of receipt of Petitioners written complaint given by them on 19.10.2016 to the 2nd Respondent and the same was endorsed to the 2nd Respondent for necessary action as illegal, arbitrary, irrational, unconstitutional and in violation of principals of natural justice and to consequently direct the 2nd Respondent to register FIR against the Respondents 3 to 5 herein to take necessary action and to do the investigation in to it expeditiously as early as possible land to pass…”

2. Heard Sri Kuruva Naganna, learned counsel for the petitioners and Mr. M.Srinivas, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 2.

3. Learned counsel for the petitioner submits that the cause of action in the present writ petition no longer survives for adjudication and, therefore, seeks dismissal of the writ petition as infructuous.

4. Learned Assistant Government Pleader raises no objection to the said submission.

5. Recording the submissions of both learned counsel, the writ petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
