ORDER:
This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief:
“…to issue an order, direction or a writ particularly one in the nature Writ of Mandamus, questioning the action of the 3rd and 4th respondents police in not conducting investigation affectiveiy for trace of boy missing case FIR No. 61/2011 Bhadrachalam Town Police Station, registered dated 25.03.2011 in respect of missing boy Miriyala Siva, S/o. Venkayya, age presently 18 years at the age of 12 years studying 6 class residing in Ananda Paul Tribal Trust Hostel inspite of several remainders and hire officials directions, the action of the respondents police 3 and 4 is illegal and void and opposed to Article 74, 19 and 21 of Constitution of India and consequently to direct the respondents police to conduct the effective investigation and trace out the missing boy and to pass.….”
2. Heard Mr.M.A.Shakeel, learned counsel for the petitioner and Mr.M.Srinivas, learned Assistant Government Pleader for Home appearing for respondents.
3. Learned counsel for the petitioner submits that the cause of action in the present writ petition no longer survives for adjudication and, therefore, seeks dismissal of the writ petition as infructuous.
4. Learned Assistant Government Pleader raises no objection to the said submission.
5. Recording the submissions of both learned counsel, the writ petition is dismissed as infructuous. There shall be no order as to costs.
Miscellaneous Petitions, pending if any, shall stand closed.
