THE HON'BLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.22524 of 2025

ORDER :

The petitioner has filed this writ petition under Article 226 of the Constitution seeking a writ of mandamus, declaring the inaction of respondents Nos.2 to 6 in failing to consider the petitioner’s representation dated 20.06.2025 for the cancellation of the pattadar pass book and title deed issued to the 7th respondent and for the restoration of the petitioner’s name in the revenue records for survey No.417/1 admeasuring Ac.4.08 guntas, located at Navabharat, Palwancha (U) Village, Palwancha Mandal, Bhadradri Kothagudem District, Telangana, as illegal and violative of natural justice. The petitioner further seeks a direction to the 4th respondent to dispose of the representation in accordance with law.

Heard Mrs.Chekuri Jyotsna Devi, learned counsel for the petitioner and Sri Surender Rao, learned senior counsel appearing on behalf of Sri Madiraju Srinivasa Rao, learned counsel for the respondent No.7 and Sri L.Ravinder, learned Assistant Government Pleader appearing on behalf of learned Government Pleader for Revenue Sri K.Muralidhar Reddy.

The learned counsel for the petitioner submits that the petitioner is the absolute owner and peaceful possessor of land in Survey No.417/1, admeasuring Ac.4.08 guntas, situated at Palwancha (U) Village, Palwancha Mandal, Bhadradri Kothagudem District, Telangana. The present writ petition is filed being aggrieved by the inaction of respondents Nos.2 to 4 in considering the petitioner’s representations dated 04.03.2025 and 20.06.2025, objecting to the proposed mutation, issuance of pattadar pass book, title deed and NALA conversion in favour of the 7th respondent in respect of land in Survey No.417/1, admeasuring Ac.3.33 guntas, situated at Navabharat, Palwancha (U) Village, Palwancha Mandal. The 7^th respondent claims rights under sale deed No.429 of 2020 executed by three vendors viz.Smt.Sriramaneni Vijaya Lakshmi, Sri Dogaparthi Aravinda Babu and Sri Mullangi Siva Reddy. However, the extents and boundaries mentioned therein materially differ from the link documents. These inconsistencies were acknowledged in O.S.No.100 of 2014, which was dismissed by the learned Principal Junior Civil Judge, Kothagudem. Subsequently, the petitioner secured an injunction in A.S.No.21 of 2019 from the learned V Additional District Judge, Kothagudem, over survey No.417/1 to an extent of Ac.4.08 guntas. Against the misrepresentations in the said sale deed, the petitioner filed O.S.No.7 of 2023 seeking its cancellation, which was dismissed by the learned Principal Senior Civil Judge, Kothagudem and is now under appeal before this Court in A.S.No.36 of 2025. Despite these proceedings and repeated representations, the respondent authorities proceeded with the mutation in favour of the 7th respondent. Ignoring objections and contrary to ROR norms, respondents Nos.4 to 6 illegally issued Bhu Bharathi Pass Books and NALA conversion orders in favour of the 7^th respondent. Respondent No.2, through letter No.Rc.E3/2420/2025 dated 03.07.2025 directed respondent No.4 to conduct a detailed enquiry and submit an action taken report. However, respondent Nos.3 and 4 failed to comply with these directions. The mutation proceedings reveal serious irregularities, as the vendors shown therein differ from those in sale deed No.429 of 2020 and the mutation was fraudulently made in the names of unrelated third parties viz.late Katireddy Lakshma Reddy and Yedamakanti Malleswari without verifying the link documents and extents. The 7th respondent further obtained the pattadar passbook and NALA conversion by suppressing the fact that A.S.No.36 of 2025 is pending before this Court. Hence, the petitioner has repeatedly requested the authorities to cancel the said pattadar passbook, title deed and NALA conversion issued in favour of the 7th respondent.
