ORDER:

This writ petition is filed seeking following relief:

“To declare the inaction of the respondent Nos.2 and 3, in taking action on the representation dated 24.11.2014 made by the petitioner herein against the illegal and unauthorized constructions being made by some unknown persons by occupying the open land belonging to GHMC and by encroaching the public road and public drainage in Sy.No.21, situated at Kamalanagar Colony, Sahebnagar Kalan Village, L.B.Nagar, Hyderabad, as illegal and arbitrary.”

2. No representation on behalf of petitioner. Sri Srinivas Rao Pachwa, learned Standing Counsel for GHMC is present.

3. Learned Standing counsel for respondent No.3, on written instructions would submit that one Palla Venkata Lakshmi, is the absolute owner of plot No.94 part, admeasuring 50 square yards in Sy.No.21 part, situated at Kamalanagar Colony, Sahebnagar Kalan Village, Hayathnagar Revenue Mandal, Ranga Reddy District and there is no encroachment of public road and drainage as alleged by the petitioner in the writ petition. He further submitted that the layout is un-approved layout and as of now there is no encroachment of public road and drainage. A copy of the written instructions along with photos, are placed on record.

4. Taking into consideration the written instructions of respondent No.3, this writ petition is disposed of, leaving it open to the petitioner herein to take appropriate steps, if cause survives. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
