Heard learned counsel for the petitioner and learned Assistant Government Pleader for Prohibition & Excise and learned Assistant Government Pleader for Home.
2. The petitioner herein is the owner of the subject vehicle i.e., Motor Car (Hyundai i20) bearing registration No.AP 36AS 8382. In proof of the same, she has filed copy of certificate of registration. The subject vehicle was seized in connection with Crime No.751 of 2023 of Subedari Police Station, Warangal Commissionerate. The petitioner herein is not an accused in the said crime. The allegation leveled against the accused in the said crime is that he was transporting five (05) boxes containing liquor bottles.
3. On the request made by the petitioner, respondent No.3 has give custody of the subject vehicle to the petitioner on her furnishing FDR for an amount of Rs.1,50,000/-. She has already furnished the said FDR and in proof of the same, she has filed copy of bankers cheque bearing No.972123, dated 04.05.2024. On consideration of the said fact only, vide proceedings dated 10.05.2024, respondent No.3 directed respondent No.4 to give custody of the subject vehicle. Even then, respond
