THE HON’BLE SRI JUSTICE PULLA KARTHIK WRIT PETITION No.28061 OF 2025

O R D E R:

With the consent of both the parties, this Writ Petition is taken up for disposal, at the admission stage itself.

2. This Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:

“...to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the 1^st Respondent in not considering the appeal filed by the Petitioner dated 22.06.2025 against the final seniority list published by the 2nd Respondent in the cadre of Motor Vehicle Inspector in Multi Zone-II vide R.No.4479/C3/2016-M.Z.II, dated 24.04.2025, to the extent of fixing of the seniority of the Petitioner from 07.12.2020 instead of 03.01.2017 is totally illegal, arbitrary, unconstitutional and void being violation of Arts.14 and 16 of the Constitution of of India apart from violation of orders of the Government in Memo.No.2221/Tr.(S and V)/2016, dated 03.01.2017 and as well as orders of the erst while Hon’ble Tribunal in 0.A.No.2411 of 2016, dated 11.07.2016 and consequently direct the Respondents to fix up the seniority of the Petitioner as Motor Vehicle Inspector and V)/2016, dated 03.01.2017 and as well as order of the erst while Honble A.P. Administrative Tribunal in O.A.No.2444 of 2016, dated 11-07-2016, as otherwise the Petitioner will be put to heavy and irreparable loss and to pass...”

3. Heard Sri Rangarajula Rajasekhara Rao, learned counsel for the petitioner and learned Government Pleader for Services-I for respondents.

Learned counsel for the petitioner submits that while the petitioner was working as Motor Vehicle Inspector, respondent No.2 has issued Revised Provisional Seniority List of Motor Vehicle Inspectors of Multi Zone-II vide Memo No.4479/C3/2016-M.Z.II dated 21.02.2025, calling for objections. Petitioner submitted his objections on 04.03.2025. However, without considering the said objections, the respondent No.2 has issued Final Seniority List vide Proceedings R.No.4479/C3/2016-M.Z.II dated 24.04.2025. Aggrieved by the same, the petitioner has filed an appeal before the respondent No.1 on 21.06.2025. According to the learned counsel, respondent No.1 is not considering the appeal filed by the petitioner. Therefore, he seeks indulgence of this Court to direct the respondent No.1 to pass appropriate orders within a stipulated period of time.

5. Learned Government Pleader appearing for the respondents submits that the respondent No.1 will consider the appeal filed by the petitioner on 21.06.2025, and pass appropriate orders in accordance with law.

Having regard to the submissions made by learned counsel for the respective parties and without going into the merits of the case, this Writ Petition is disposed of directing respondent No.1 to consider and dispose of the appeal filed by the petitioner on 21.06.2025, strictly in accordance with law, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order and communicate a copy thereof to the petitioner.

Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
