ORDER:

This Writ Petition is filed seeking the following relief:

“…to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondent No.4 in entertaining and registering documents in respect of Lands bearing Sy.No.25 (Ac.7-09 Gts.), Sy.No.29 (Ac.7- 19 Gts.), Sy.No.30 (Ac.4-36 Gts.), Sy.No.31 (Ac.8-35 Gts.), Sy.No.32 (Ac.9-04 Gts.), Sy.No.107 (Ac.1-28 Gts.), Sy.No.108 (Ac.1-18 Gts.), Sy.No.111 (Ac.2-00 Gts.), Sy.No.112 (Ac.1-10 Gts.), and Sy.No.113 (Ac.1-13 Gts.), totally admeasuring Ac.45-12 Gts. situated Gudur (Village), Kandukur (Mandal), Ranga Reddy (District) as arbitrary, illegal and without jurisdiction and contrary to Status Quo Order dated 20.03.2017 in IA No. 229/2017 in OS No.275/2017 passed by the III Additional District Judge, Ranga Reddy District, at L.B.Nagar and Circular Memo No.1/Gen.1/2010 dated 10.03.2010 and contrary to list of prohibited properties and consequently direct the Respondent No.1 and 5 herein not to entertain and register any documents in respect of Lands bearing Sy.No.25 (Ac.7-09 Gts.), Sy.No.29 (Ac.7-19 Gts.), Sy.No.30 (Ac.4-36 Gts.), Sy.No.31 (Ac.8-35 Gts.), Sy.No.32 (Ac.9-04 Gts.), Sy.No.107 (Ac.1-28 Gts.), Sy.No.108 (Ac.1-18 Gts.), Sy.No.111 (Ac.2-00 Gts.), Sy.No.112 (Ac.1-10 Gts.), and Sy.No.113 (Ac.1-13 Gts.), totally admeasuring Ac.45-12 Gts. situated Gudur (Village), Kandukur (Mandal), Ranga Reddy (District)

and pass....”

2. Heard Mr. N. Praveen Reddy, learned counsel for petitioner and Ms. Dara Haritha Kiran, learned Assistant Government Pleader for Stamps and Registration appearing for respondent Nos.1 to 5. There is no representation on behalf of unofficial respondents.

Learned counsel for petitioner submitted that with respect to the schedule properties in the writ petition, a suit bearing No.275 of 2017 was filed by petitioner before the Principal District Judge, Ranga Reddy District at L.B.Nagar. I.A.No.229 of 2017 in O.S.No.275 of 2017 was filed by petitioner before the III Additional District Judge, Ranga Reddy District at L.B.Nagar and on 20.03.2017, learned III Additional District Judge, passed interim order directing the parties to maintain status-quo. The said order was brought to the notice of respondent authorities. Inspite of status-quo order presented to the concerned Sub-Registrar, the Sub-Registrar entertained and registered the documents in respect of certain lands in various survey numbers, total land admeasuring Ac.45-12 gts, situated at Gudur Village, Kandukur Mandal, Ranga Reddy District. Registration of such documents has been challenged in this Writ Petition.

4. Inspite of service of notice, no counter affidavit is forthcoming.

5. Learned Assistant Government Pleader for Stamps and Registration invited attention of this Court to a note presented and attested by respondent No.4. The relevant contents of the note are as follows:

“The petitioner under Para 7 alleged that the Respondents are making alienations and the Sub Registrar has registered more than 50 sale deeds vide document No.3501/20197192/2019, 13352/2019, 5237//2020, 2846/2020, 13282/2020, 13255/2020, 13171/2020, 3876/2021 and 3875/2021 in spite of entry in prohibited properties. It is submitted that it is incorrect to say that the properties registered are part of suit schedule property. All the above listed documents were part of the properties developed vide DAGPA No. 10371/2007 (Copy of EC submitted). Stoppage of registration of properties which were sold in the same survey numbers and which are not part of the suit schedule property is against the principles of natural justice.

In response to Para 8 it is submitted that there is no violation of C& IG Cir.Memo No.1/Gen. 1/2010 dated. 10.03.2010 or Registration Act or Rules in registration of documents after receipt of Status quo orders.
