COMMON ORDER:

Heard Sri N.Sreedhar Reddy, learned counsel for the petitioners in both the writ petitions, Sri T.Ravi Kumar, learned Assistant Government Pleader attached to the office of learned Advocate General and Sri P.Sri Raghu Ram, learned Senior Counsel representing Mr.P.Sri Ram, learned counsel for respondent No.5 in both the writ petitions.

Petitioners in W.P.No.482 of 2025 are claiming that they are the absolute owners and possessors of land admeasuring 12600 square yards in Sy.No.41/11/A, situated at Khanamet Village, Serilingampally Mandal, Ranga Reddy District. It is their specific contention that the subject property is their ancestral property. They have narrated the said facts in paragraph Nos.2 and 3 of the writ affidavit. According to them, on the request made by respondent No.5, Deputy Inspector of Survey, Survey and Land Records, Ranga Reddy District, issued notice dated 19.12.2024 to conduct survey on 08.01.2025. Challenging the said notice, petitioners filed the present writ petition.

3. It is the specific contention of the petitioners that they were not put on notice. Earlier survey was conducted on 02.07.2015 in the presence of HMDA. Again a survey was conducted on 26.07.2018. In proof of the same, petitioners have filed location sketch of Sy.No.41. Therefore, conducting the survey on the request made by respondent No.5 does not arise. Respondent No.5 is not in a position to locate its property. It is claiming that the land admeasuring Acs.5.00 guntas in Sy.No.41 of Khanamet Village, under a registered sale deed bearing document No.3958 of 1996, dated 23.05.1996. Therefore, they are trying to occupy the vacant land in Sy.Nos.41/11/A and 41/12.

4. Sri N.Sreedhar Reddy, learned counsel for the petitioners, on instructions, would submit that total land in Sy.No.41 of Khanamet Village is 258 acres. Sy.No.41/12 is fully occupied by the houses. Even then, on the request made by respondent No.5, Deputy Inspector of Survey, Survey and Land Records, Ranga Reddy District, issued notice dated 19.12.2024. He would further submit that for the purpose of conducting survey in the urban areas, procedure is different. For conducting survey in respect of agricultural property, respondent No.5 has to submit F-Line application to the Competent Authority. On instructions, he would further submit that if Deputy Inspector of Survey, Survey and Land Records, Ranga Reddy District, conduct survey and demarcate the land which belongs to respondent No.5 i.e., land admeasuring 5 acres in Sy.No.41/12 of Khanamet Village, petitioners have no objection but he has to conduct survey strictly in accordance with law by putting the petitioners on notice and affording them an opportunity.

Petitioners in W.P.No.519 of 2025 are claiming that they are the absolute owners and possessors of land admeasuring 7200 square yards in Sy.No.41/12/A part, situated at Khanamet Village, Serilingampally Mandal, Ranga Reddy District, on the strength of the registered sale deed bearing document No.4691 of 2022, dated 25.01.2022. Rectification deed bearing document No.7967 of 2024, dated 22.04.2024, was also executed correcting the boundaries.

Sri N.Sreedhar Reddy, learned counsel for the petitioners on instructions would submit that if Deputy Inspector of Survey, Survey and Land Records, Ranga Reddy District, conduct survey and demarcate the land which belongs to respondent No.5 i.e., land admeasuring 5 acres in Sy.No.41/12 of Khanamet Village, petitioners have no objection but he has to conduct survey strictly in accordance with law by putting the petitioners on notice and affording them an opportunity.

7. Learned Assistant Government Pleader, on instructions, would submit that there is no separate procedure to conduct survey of urban properties. The Deputy Inspector of Survey, Survey and Land Records, Ranga Reddy District, will conduct the survey strictly in accordance with law
