ORDER
This Writ Petition is filed to issue a Writ of Mandamus declaring the impugned demand notice No.10332/2012-13 issued by respondent No.3 under Section 633 of the GHMC Act, 1955, as illegal, arbitrary and unconstitutional.
2. Heard Sri P.Madhusudhana Reddy, learned counsel for petitioner, and Sri K.Ravi Mahender, learned Standing Counsel for respondent Nos.2 and 3.
3. Learned counsel for the petitioner submitted that the petitioner is owner and possessor of house bearing H.No.14-1-90, Plot No.318, Gayatrinagar, Borabanda, Hyderabad and has been paying the property tax regularly @ Rs.4,020/- per annum since the year 2013. He further submitted that before revising/enhancing the property tax from Rs.4,020/- per annum to Rs.11,572/- per annum, respondent Nos.2 and 3 have not followed the procedure contemplated under the provisions of the GHMC Act and no notice has been issued to the petitioner. Learned counsel further submitted that the petitioner made a representation dated 25.03.2015 to retain the property tax @ Rs.4,020/- instead of Rs.11,572/-, but the respondent has not considered the said representation and taken any action in that regard. Hence, the present Writ Petition is filed.
4. He further submitted that the respondents would consider the representation dated 25.03.2015 submitted by the petitioner and pass appropriate orders within a period of two months.
5. Considering the submissions made by learned counsel for petitioner as well as the learned Standing Counsel for respondent Nos.2 and 3, this Writ Petition is disposed of directing respondent No.3 to consider the representation dated 25.03.2015 submitted by the petitioner and pass appropriate orders strictly in accordance with the provisions of the GHMC Act, by duly affording opportunity of hearing to the petitioner, within a period of two months from the date of receipt of a copy of this order.
6. Miscellaneous petitions pending, if any, shall stand closed.
