ORDER:

Heard Ms. G. Sridevi, learned counsel representing Mr. M. Srikanth, learned counsel for the petitioner; Mr. R. Nagarjuna Reddy, learned Assistant Government Pleader for Health, Medical and Family Welfare Department appearing for respondent No.1 and Mr. T.Sharath, learned Standing Counsel for Kaloji Narayana Rao University of Health Sciences appearing for respondent No.2 (for short ‘the University’).

The petitioner approached the respondent University along with documents to consider her as a ‘Local Candidate’ for admission to MBBS/BDS Course in the Medical institutions of the State of Telangana for the academic year 2025-26 in terms of advertisement dated 15.07.2025. She claims to fall in the category prescribed under G.O.Ms.No.150 dated 08.09.2025.

3. Learned counsel for the petitioner submits that the petitioner has studied upto 10^th class in Madras. Thereafter, by residing in the State of Telangana at Hyderabad, she has completed her Intermediate for the academic years 2020-21 and 2021-22 and thereafter, she attended EAMCET-2023 and NEET-2024 examinations. Therefore, her stay being consecutive four years in Hyderabad, she fulfils the requirement prescribed in G.O.Ms.No.150 dated 08.09.2025. Therefore, the petitioner may be permitted to make a written representation seeking to consider her case as a ‘Local Candidate’ and the respondents may be directed to consider the same.

Learned Standing Counsel for the respondent University at the outset submits that the relevant criteria under G.O.Ms.No.33 dated 22.07.2024 read with G.O.Ms.No.150 dated 08.09.2025 require either consecutive study or consecutive stay, and not a piecemeal. Study for any period in the last four consecutive years preceding the qualifying exam outside the State is only permissible if the parent of the candidate falls in any of the enumerated categories under G.O.Ms.No.150 dated 08.09.2025, which, in the present case, petitioner does not fulfill. However, he submits that if the petitioner makes any representation, the respondents shall consider the same in accordance with law.

Upon hearing learned counsel for the parties, without making any comments on the merits of the claim of the petitioner, we dispose of the Writ Petition with liberty to the petitioner to make a representation to the respondent University to consider her case as a Local Candidate. Thereupon, the respondent University shall consider the same in accordance with law, within a period of two days. However, there shall be no order as to costs.

Miscellaneous applications pending, if any, shall stand closed.
