IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE N.TUKARAMJI
N.Dayanand Goud – Appellant
Versus
The State of Telangana Home Department – Respondent
WP 19393/2017

THE HONOURABLE SRI JUSTICE N.TUKARAMJI WRIT PETITION No.19393 OF 2017

ORDER:

This Writ Petition is filed with the following relief:

“...to issue a Writ, Order or Direction, more particularly one in nature of Writ of MANDAMUS to declare the action of the respondents 1 & 4 in interfering with the construction work of the petrol pump in land in Sy.No.141/4, Nedurgul Village, R.R.District which is being raised in pursuance of the letter of appointment issued to the petitioner on 10.04.2017, as illegal, arbitrary and colourable exercise of powers/ extraneous considerations and consequently to restrain the respondents 1 to 4 from interfering with the construction work of petrol pump by the petitioner in land in Sy.No.141/4, Nedurgul Village, R.R.District in the interest of Justice...”

2. None appears on behalf of the petitioner.

3. Heard learned Assistant Government Pleader for Home appearing for respondent Nos. 1 to 4.

4. The learned Assistant Government Pleader for Home submits that respondent Nos. 1 to 4 have never interfered with the petitioner’s construction activities, as alleged. It is further submitted that, based on a representation made by respondent No. 6, Crime No. 398 of 2017 was registered against the petitioner. The present writ petition, according to the learned Assistant Government Pleader, has been filed only to obstruct or interfere with the due course of investigation. It is contended that the allegations made by the petitioner are devoid of any supporting material. Hence, prayed that the writ petition be dismissed.

5. I have perused the material placed on record.

6. This Court, by an earlier order dated 15.06.2017, directed the respondent-police authorities to act strictly in accordance with law. Having regard to that direction and to the nature of the dispute raised by the petitioner, particularly the allegation concerning interference by respondent Nos. 1 to 4 in a construction activity, which is essentially civil in nature, it is deemed appropriate to reiterate that respondent Nos. 1 to 4 shall not interfere in any manner with the petitioner’s construction work or civil dispute, except in strict conformity with law and by following due process.

7. With this direction, this Writ Petition is disposed of.

There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
