ORDER

Heard learned counsel for the petitioner and Sri.G.Aniketh Reddy, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 5. With their consent, this writ petition is being taken up for disposal at the admission stage itself.

2. This writ petition has been filed seeking the following prayer:-

“to declare the action of the respondents 4 and 5 in insisting the petitioner for a settlement with the accused in FIR No.1149 of 2024 dated 05.10.2024 for the offences U/Sec 3(1) (s) of SC and ST POA Act on the file of the 4th respondent as illegal, Arbitrary, violative of principles of Natural Justice and violative of Article 14 of the constitution of India.”

Brief facts stated in this writ petition are that on 01.10.2024, petitioner lodged a complaint and requested respondent No.4 to take action and soon after receiving the complaint, respondent No.4 called the person against whom the complaint was made and after speaking with them, respondent No.4 advised petitioner to change the averments made in complaint. However, petitioner refused to do the same. Thereafter, petitioner made several efforts for registration of FIR. It is further submitted that respondent Nos.4 and 5 have altered/tampered petitioner’s complaint and registered FIR No.1149 of 2024 dated 05.10.2024, for the offences under Section 3(1) (s) of SC and ST POA Act. The case of the petitioner is that the respondent Nos.4 and 5 2024 dated 05.10.2024. Aggrieved by the same, the present writ petition is

filed.

Learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 5 placed on record instructions issued by Sub-Inspector of Police, KPHB colony Police Station, Cyberabad Commissionerate, wherein it is submitted that on 04.10.2024, petitioner lodged a complaint before respondent No.4 stating that she belong to SC caste and one Varalaxmi, abused her by touching her caste name. On such complaint, respondent No.4 registered FIR No.1149 of 2024 dated 05.10.2024 under Section 3(1) (s) of SC and ST POA Act. During the course of investigation, petitioner as well as five witnesses were examined and their detailed statements were recorded. The witnesses stated that no one abused the petitioner in her caste name either in the premises of Additional Family Court cum VI Additional District Judge, Ranga Reddy or in the entire court complex. It is further submitted that the petitioner had failed to produce any evidence in support of her averments made in complaint. Since, no evidence was produced, the investigating officer after obtaining permission Vide letter No.9/SC-St (PAO) DCP-BZ/Cyb/2025 dated 06.05.2025, from the Deputy Commissioner of Police, Balanagar Zone closed the case as “Lack of Evidence”. Notice to that effect was also served on the petitioner through registered post on 25.09.2025 and final report was also filed before the concerned Court.

5. Learned Assistant Government Pleader for Home submits that the respondent police has discharged their legitimate duties and except conducting investigation, the respondent Nos.4 and 5 neither insisted the

05.10.2024 nor has harassed, insulted or misbehaved with the petitioner.

Recording the submissions made by the learned counsel appearing on either side, without expressing any opinion on the merits of the case and since FIR No.1149 of 2024 dated 05.10.2024 was closed as “Lack of Evidence” and the respondent authorities have also final report before the concerned Court, this writ petition is disposed of granting liberty to petitioner to seek appropriate remedy as available under law before the concerned Court.

7. With the above observation, this writ petition is disposed of. Miscellaneous applications, if any pending, shall stand closed. No order as to costs.
