ORDER:

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.1 and 2 in Crime No 198 of 2025 of Mothey Police Station, Suryapet, registered for the offences punishable under Sections 338, 318(4), 318(2), 340(2), 303(2) r/w 3 (5) of BNS and Section 3 of PDPPA.

2. Heard Sri Banavath Nageshwar Rao, learned counsel appearing on behalf of the petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

3. Learned Counsel appearing on behalf of the petitioners submitted that the petitioners have not committed the alleged offences. He further submitted that the police have not served notice under Section 35 (3)

of BNSS (previously Section 41-A of Cr.P.C.) to the petitioners. Therefore, he prayed that this Court may be pleased to grant pre-arrest bail to the petitioners by allowing this criminal petition.
