ORDER

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 5. With their consent, this writ petition is being taken up for disposal at the admission stage itself.

2. This writ petition has been filed seeking the following prayer:-

“to declare the in action of the Respondents No.2 to 5 to register an FIR against Respondents Nos.6 to 15 for the offences committed by them i.e., cheating, forgery and fabrication of documents under Sections 318, 335 and 336 of BNS without considering my complaints/representations as illegal, arbitrary and violative of principles of natural justice and Articles 19, 21 and 300-A of Constitution of India besides violative of principles of natural justice and consequently direct the Respondent No.2 to 5 to register a FIR.”

Brief facts stated in this writ petition are that petitioner No.2 claims that his father i.e., Sri.Jagan Mohan, had purchased land admeasuring to an extent of Ac.1-31, Gts, in Sy.No.767/8/5, situated at Vinjamuru Village, Chintapally Mandalam, Nalgonda District, through registered sale deed bearing document No.147 of 1987 dated 24.01.1987. The case of the petitioners is that the respondent No.6, by creating forged and fabricated documents, issued ownership certificates with respect to land to an extent of 122 Sq.yards and 244.44 Sq.yards in Sy.No.767/8/5 to respondent Nos.7 and 8 and basing on the said certificates, respondent No.11 got registered the said land on his name. Hence, the petitioners on 10.04.2023 made an application before the District Panchayat Officer, Nalgonda, seeking cancellation of the fabricated documents and the same is under consideration. Further case is that the petitioners on 19.09.2022, 14.10.2022 and 24.07.2025 lodged complaints before the respondent authorities and requested to take action against the unofficial respondents. However, till date the respondent authorities had not registered FIR against the petitioners’ complaints dated 19.09.2022, 14.10.2022 and

24.07.2025. Aggrieved by the same, this writ petition is filed.

Learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 5 placed on record instructions issued by Sub-Inspector of Police, Chintapally Police Station, Nalgonda District, wherein it is stated that petitioners’ complaint dated 24.07.2025 was received by respondent No.5 on 29.07.2025 and basing on the said complaint, GD entry vide petition No.Ack.No.NLG/CHPP_NLG/290725/00516 dated 29.07.2025, was made and during the course of enquiry the following facts were revealed:-

(i) Verification of records and revenue documents was conducted for survey No.767/8/5, Vinjamuru Village. The land was originally purchased by Late Jaganmohan and correctly reflected in the Passbook No.T28050100196, Khata No.237.

(ii) The alleged forged “Ownership Verification Certificates” and house registration documents were examined Documents allegedly issued by Village Officials G.Venkataiah, Srikant and Santosh were reviewed.

(iii) Evidence collected indicated the dispute primarily involves civil/revenue matters, including title, mutation, and ownership entries.

(iv) No direct evidence was found to establish criminal trespass or criminal intimidation by the petitioners against the accused officials in the scope of this enquiry.

(v) The matter essentially concerns civil/revenue adjudication and is under the jurisdiction of competent Revenue and Civil authorities.

(vi) The petitioners were advised to approach the Revenue Divisional Officer (RDO) or file a civil suit for rectification of entries, cancellation of fraudulent mutations, and restoration of their lawful ownership.

(vii) Moreover a civil case before the Hon’ble IV Additional District Judge Nalgonda, is pending vide O.S.No.12 of 2023.
