O R D E R:

With the consent of both the parties, this Writ Petition is taken up for disposal at the admissions stage.

2. This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:

“...to issue a writ, order or direction, more particularly, one in the nature of writ of mandamus, declaring the action of the respondents in not considering the name of the petitioner for promotion to the post of Gazetted Head Master (GHM) Grade II as per G.O. Ms. No.66 General Administration (Ser-C) Department Dt. 30-01-1991 and further as per G.O. Ms. No.257, G.A. (Ser-C) Department., Dt. 10-06-1999, as illegal, arbitrary, unjust and in violation of articles 14, 16, 19 and 21 of Constitution of India and consequently direct the respondents to promote the petitioner for the post of Gazetted Head Master (GHM) Grade II as per G.O. Ms. No.66 General Administration (Ser-C) Department Dt. 30-01-1991 and further as per G.O. Ms. No.257, G.A.

(Ser-C) Department., Dt. 10-06-1999 and pass...”

3. Heard Sri Tarun Ram Aitham, learned counsel for the petitioner, and learned Government Pleader for Services-I, on behalf of the respondents.

Learned counsel for the petitioner submits that while the petitioner was working as School Assistant/in-charge Head Master (FAC), Zilla Parishad High School for Girls, Madhira, Khammam, an ACB case vide Crime No.02/RCT-KMM/2023 was registered against her, for the offence punishable under Sections 7(a) and 7(b) of the Prevention of Corruption Act, 1988, and a charge sheet was filed therein, which was numbered as C.C.No.23 of 2025 on the file of the Special Court for SPE and ACB Cass-cum-III Additional District and Sessions Judge, Warangal. In connection with her involvement in the ACB case, the petitioner was placed under suspension on 26.02.2023, and was later reinstated into service on 02.07.2025. While the things stood thus, applications were called for from the eligible candidates for promotion to the post of Gazetted Head Master Grade-II. It is submitted that the petitioner has been continuously working as School Assistant (Mathematics) from 08.10.2002, and is thus fully eligible and entitled for promotion to the said post. Therefore, the petitioner submitted her application on 02.08.2025. However, the respondents are not considering her case for promotion, on the ground of her involvement in the ACB case. Therefore, learned counsel prays this Court to direct the respondents to consider the case of the petitioner for promotion to the post of Gazetted Head Master (Grade-II) in terms of the orders issued in G.O.Ms.No.257 dated

10.06.1999.

Learned Government Pleader for the respondents submits that the ACB case filed against the petitioner is pending adjudication, and therefore, she is not eligible for promotion to the post of Gazetted Head Master Grade-II. However, it is fairly submitted that the respondents will consider her case for promotion in terms of G.O.Ms.No.257 dated 10.06.1999.

Having regard to the submissions made by learned counsel for the respective parties, this Writ Petition is disposed of directing the respondents to consider the case of the petitioner for promotion to the post of Gazetted Head Master (Grade-II), as and when promotions are effected, strictly in terms of the orders issued in G.O.Ms.No.257, General Administration (Ser.C) Department, dated

10.06.1999.

Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
