ORDER:

Heard Sri Nayakwadi Ramesh, learned counsel appearing on behalf of the petitioners and learned Assistant Government Pleader for Services-I I appearing on behalf of the respondents.

2. The petitioners approached the Court seeking prayer as under:

“…to issue a writ order or direction more particularly one in the nature of Writ of MANDAMUS to declare the action of the respondents in not considering claim of the petitioners for regularization of their services in the cadre of Panchayat Secretary Gr.IV in terms of G.O. Ms No. 379 PR & RD (Mdl.II) Dept., dated 14.08.2013 is illegal, arbitrary and unconstitutional apart from violative of Principles of Natural Justice and consequently to direct the respondents to consider the claim of the petitioners for regularization of their services in the cadre of Panchayat Secretary Gr. IV in terms of G.O.Ms.No.379 PR &RD (Mdl.II) Dept., dated 14.08.2013 along with others with all consequential benefits and pass…”

3. The case of the petitioners in brief as per the averments made in the affidavit filed by the petitioners in support of the present Writ Petition is as under:-

The 1st petitioner had been appointed as Panchayat Secretary on contract basis on humanitarian grounds as a special case, in relaxation of rules. The respondent Nos. 3 & 4 had appointed the 1^st petitioner as Panchayat Secretary on contract basis and posted to Gram Panchayat Madannapet of Kamalapur Mandal in the existing vacancy vide proceedings No.2133/2013/A3, dated 13.06.2018 and the 2^nd petitioner was appointed as Panchayat Secretary on contract basis on humanitarian grounds as a special case and posted to Gram Panchayat, Dooskal of Farooqnagar Mandal in the existing vacancy vide proceedings No.446/2010-A1(Pts), dated 22.02.2019 and since the appointment to the above said posts, petitioners had been discharging their duties to the utmost satisfaction of their superior officers without any remarks from any corner.

It is further the case of the petitioners that in spite of detailed requests made by the petitioners for consideration of the claim of the petitioners for regularization of their services in the cadre of Panchayath Secretary Grade IV in terms of G.O.Ms.No.379 PR & RD (Mdl.Ii) Dept., dated 14.08.2013 and in spite of petitioners possessing requisite qualifications, the same had not been considered as on date and aggrieved by the same, the writ petition is filed.

4. PERUSED THE RECORD.

A. The Memo No.CPR&RE/ B3/ ESTT/ SRMT/ 17/ 2020, dated 28.07.2021 of office of the Commissioner of Panchayat Raj and Rural Employment, Urdu Hall Lane, Himayathnagar, Hyderabad is extracted hereunder:- Attention of the District Panchayat Officers, Nizamabad, Karimnagar, arangal Urban, Yadadri-Bhuvanagiri, Jagityal, Sangareddy and Ranga reddy are invited to the references cited.

In the reference 1" cited the proposals for regularization of the below shown candidates were submitted to the Government.

In the reference 2nd cited, the Government has requested to furnish in detail, whether the above shown (7) Panchayat Secretaries working on Contract basis are fulfilled all the conditions for regularization of their services as Panchayat Secretaries Grade-IV to the Government for taking further action in the matter.

In view of the above, it is requested to submit the detailed report whether the above shown (7) Contract Panchayat Secretaries have fulfilled all the conditions required for regularization of their services as Panchayat Secretary in Grade-IV or not i.e., Educational qualifications, and any disciplinary cases pending against them etc., to s
