O R D E R:

This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure, 1908 by the petitioner to transfer H.M.O.P.No.19 of 2024 on the file of the Senior Civil Judge at Ramannapet, Yadadri Bhuvanagiri District to the file of the Judge, Family Court, Ranga Reddy District at L.B.Nagar.

2. Heard Sri K. Venumadhav, learned counsel for the petitioner.

3. No representation for the respondent. Notice sent to respondent was returned unserved with endorsement ‘refused’.

Hence, notice deemed to be served.

4. The reasons cited for transfer are that the petitioner is currently residing in Hayathnagar, Ranga Reddy District with her parents and DVC case vide No.10 of 2024 and a criminal case filed by her against respondent herein are pending on the file of the XIV Additional Metropolitan Magistrate at Hayathnagar. In addition, a criminal case filed by her against the respondent is pending on the file of the III Additional Metropolitan Magistrate, Cyberabad, Ranga Reddy District at L.B.Nagar. Hence, prayed to transfer H.M.O.P.No.19 of 2024 filed by the respondent herein, pending on the file of the Senior Civil Judge at Ramannapet, Yadadri Bhuvanagiri District to the file of the Judge, Family Court, Ranga Reddy District at L.B.Nagar, in order to conveniently attend all the cases.

5. Since there are catena of judgments of the Hon’ble Supreme Court to consider the convenience of wife while transferring matters arising out of matrimonial disputes, keeping in view of the convenience of the petitioner herein, the relief prayed for is granted.

6 In the result, the Transfer Civil Miscellaneous Petition is allowed and the H.M.O.P.No.19 of 2024 filed by the respondent herein, pending on the file of the Senior Civil Judge at Ramannapet, Yadadri Bhuvanagiri District is withdrawn and transferred to the file of the Judge, Family Court, Ranga Reddy District at L.B.Nagar. The entire original record shall be transmitted within a period of one month. There shall be no order as to costs.
