THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.42672 of 2022

ORDER:

This writ petition is filed seeking the following relief:

“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the endorsement bearing Rc.No. B/10373/2019, dt.22.02.2020 in giving declaration that the land of the petitioners in Sy.No.545/B to an extent of Ac.1.20, 551/A2/1 to an extent of Ac.1.20 guntas situated at Cheemalabai Thanda Grampanchayat, Palakurthy Mandal, Jangaon District in favour of the 5th respondent which is illegal and arbitrary, null and void and against the procedure lay down under the Telangana ROR Act, 2020 and also against the principles of natural justice and consequently to direct the respondents 2 to 4 to restore the land of the petitioners on their names by deleting from the Dharani Portal as well as e-

passbook issued in favour of the 5th respondent”

2. Heard Mr. J.Kanakaiah, learned Senior Counsel for the petitioners and the learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 4.

Learned Senior Counsel for the petitioners submits that a detailed representation was made before respondent No.2 stating that the petitioners are the absolute owners and possessors of the property in Survey Nos.545/B and 551/A2/1. It is contended that the petitioner No.1 has also obtained a bank loan and possess all supporting documents. However, the Tahsildar, in collusion with respondent No.5 and with the assistance of the police officials, has ignored the claim of the petitioners and unlawfully recorded the name of respondent No.5. He submits that respondent No.4, on instructions, visited the property, conducted enquiry in the presence of village elders and recorded their statements, all of whom (except the unofficial respondent) supported the case of the petitioners. Despite such findings being reflected in the revenue records, no corrective action has been taken. Aggrieved thereby, the petitioners submitted a detailed representation on 10.01.2022, but the same has not been acted upon till date. Left with no alternative remedy, the present writ petition has been filed.

On the other hand, learned Assistant Government Pleader for Revenue submits that the grievance of the petitioners is essentially civil in nature and they ought to have approached the competent Civil Court. However, he fairly submits the representative dated 10.01.2022 is still pending consideration. However, he contends that liberty may be granted to the petitioners to make a fresh detailed representation before respondent No.3, who in turn may be directed to examine the same and pass appropriate orders in accordance with law.

5. Having heard both sides, this Court is of the considered opinion that no prejudice would be caused if liberty is granted to the petitioners to approach the authorities afresh.

Accordingly, the writ petition is disposed of granting liberty to the petitioners to file a fresh detailed representation along with all supporting documents before respondent No.3 within a period of four (04) weeks from the date of receipt of a copy of this order. Upon such representation being filed, the respondent No.3 shall consider the same, issue notices to all concerned, afford due opportunity of hearing to the parties and pass appropriate orders strictly in accordance with law, as expeditiously as possible, preferably within a period of sixteen (16) weeks thereafter. No order as to costs.

As a sequel thereto, miscellaneous applications, if any pending, in this petition, shall stand closed.
