ORDER:
This writ petition is filed questioning the action of the respondent No.2 in not registering the Gift Deed executed by the petitioner No.1 in favour of the petitioner No.2 submitted vide Application No.2400363296 in respect of the land admeasuring to an extent of Ac.1-08 gts in Sy.No.180 situated at Yadgarpally Village, Miryalguda Mandal, Nalgonda District without any valid reason as illegal and arbitrary.
2. Heard Sri P. Pandu Ranga Reddy, learned counsel for the petitioners, Smt S. Sravanthi, learned Assistant Government Pleader for Revenue for the respondent Nos.1 and 2 and Sri Rapolu Bhaskar, learned counsel for the respondent No.3.
3. Learned Counsel for the respondent No.3 submits that respondent No.3 has made application before the registering authorities not to register the document in view of the application for mutation of the records is pending before the District Collector, Nalgonda.

Learned Counsel for the petitioner has produced the orders of the District Collector, Nalgonda vide Proceedings No.E3/5770/2024 dated 25.06.2025 in rejecting the request made by the respondent No.3 for mutation of the records and directing him to approach the competent Civil Court and in view of the same, the respondent authorities cannot stop registration of the document presented by the petitioners without any reason and if for any reason the respondent authorities are refused to register the document, they may be directed to follow the provisions under Section 71-A of the Registration Act, 1908 and moreover, the respondent No.3 is at liberty to question the order passed by the District Collector, Nalgonda vide Proc.No.E3/5770/2024 dated 25.06.2025 in appropriate proceedings.

In view of the aforesaid submissions, the Writ Petition is disposed of directing the respondent No.2 to process the Application No.2400363296 of the petitioners for registration of Gift Deed in respect of the land admeasuring to an extent of Ac:1-08 gts in Sy.No.180 situated at Yadgarpally Village, Miryalguda Mandal, Nalgonda District presented by the petitioners subject to the petitioners complying with the provisions of the Registration Act, 1908 as well as the Indian Stamp Act, 1899. It will be open to the Registering Authority to refuse the document presented before it if there is any objection by duly assigning reasons in support of such decision and communicate the said decision to the petitioners.

It is made clear that mere registration of the document does not confer title on the subject property and it is also made clear that this order would not have any bearing on all those matters where title/rights of the parties are pending before the authorities either in revision/appeals for adjudication and in any other case this order also does not preclude the parties in asserting their rights before a competent Court of law. There shall be no order as to costs.
7. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
