ORDER:

Heard Mr. Srinivas Kapatia, learned counsel for the petitioner; Mr. Tandra Ramesh, learned Assistant Government Pleader for Health, Medical and Family Welfare Department appearing for respondent No.1 and Mr. T.Sharath, learned Standing Counsel for Kaloji Narayana Rao University of Health Sciences appearing for respondent No.2 (for short ‘the University’).

The petitioner seeks to be treated as a ‘Local Candidate’ for the State of Telangana for the purposes of admission to the Competent Authority Quota in Medical institutions in the State for the academic year 2025-2026 as per the advertisement dated 15.07.2025. Petitioner contends that she has studied up to Class-X in educational institutions within the State of Telangana but due to transfer of his father who is working with Railway Protection Force (RPF) and was posted at Nanded in the State of Maharashtra, she undertook her intermediate education in Residential Junior College, Visakhapatnam, which falls within the State of Andhra Pradesh. Petitioner submits that in terms of the decision of the Apex Court in The State of Telangana v. Kalluri Naga Narasimha Abhiram, CA @ SLP (C) Nos.21536-21588 of 2024 etc. dated 01.09.2025 (Annexure P9) and G.O.Ms.No.150 dated 08.09.2025, the respondents should consider her case as a ‘Local Candidate’ for admission to the MBBS/BDS Course.

Learned Standing Counsel for the respondent University submits that for the petitioner to fall in the category of ‘Local Candidate’, the conditions stipulated in G.O.Ms.No.150 dated 08.09.2025 have to be satisfied. If the petitioner is able to produce two certificates i.e., (1) the Certificate of Nativity of the State of Telangana and (2) the Certificate for having studied for the last two years preceding the qualifying exam outside the State commensurate with the period of posting of his father in

Railway Protection Force (RPF) i.e., paramilitary force, apart from the previous education for the remaining two years in the State of Telangana i.e., up to Class-X, her case can be considered as a ‘Local Candidate’ in the ensuing admission process.

In the light of what has been noted above, liberty is granted to the petitioner to approach the respondent University with the requisite certificates as above for being treated as a local candidate for admission to the MBBS/BDS Course under Competent Authority Quota in the Medical Institutions in the State of Telangana under advertisement dated 15.07.2025. If the petitioner approaches the respondent University with the aforesaid certificates and satisfies the aforesaid conditions, her case may be considered as a local candidate in the ensuing admission process. Let such consideration be made, as expeditiously as possible, upon filing of such certificates before the respondent University on the part of the petitioner.

5. The Writ Petition is disposed of accordingly.

However, there shall be no order as to costs.

Miscellaneous applications pending, if any, shall stand closed.
