ORDER (ORAL):
This writ petition is filed seeking to declare the action of the respondent authorities in not considering the representation of the petitioner dated 17.02.2025 requesting to take action on the illegal construction made by respondent No.5 in the premises bearing H.No.13- 9-121/A, Lalitanagar Colony, situated at Saroornagar Circle, as illegal and arbitrary.
2. Heard learned counsel for the petitioner, learned Assistant Government Pleader for MAUD appearing for respondent No.1 and Mr. Srinivasa Rao Pachwa, learned Standing Counsel for GHMC appearing for respondent Nos.2 to 4.

Mr. Srinivasa Rao Pachwa, learned Standing Counsel for GHMC furnished written instructions along with copies of Show Cause Notice dated 14.08.2024, Speaking Order dated 23.08.2024 and Letter dated 09.09.2024. He submitted that one Sri A. Bhaskar Reddy had obtained building permission vide Permit No.302853/6319/GHMC/2023, dated
19.06.2023 for construction of Stilt + 2 upper floors at premises bearing Plot No.23, East Part, H.No.13-9-121/A, Lalitha Nagar, Gaddiannaram, Saroornagar, Hyderabad and another person by name Smt. Rajoli Veena Kumari had obtained building permission vide Permit No.302923/6320/GHMC/2023, dated 19.06.2023 for construction of Stilt + 2 upper floors at premises bearing Plot No.23, West Part, H.No.13-9-121/A, Lalitha Nagar, Gaddiannaram, Saroornagar, Hyderabad. He further submitted that during a routine inspection, it was observed that Sri Bhaskar Reddy and Smt. Rajoli Veena Kumari are proceeding with construction in deviation to sanction plan and unauthorizedly made Cellar + Ground + 1st, 2nd, 3rd and 4th upper floors by constructing a single building and not maintaining mandatory setbacks at eastern and western parts of Plot No.23. In view of the same, the respondent authorities issued show cause notice dated 14.08.2024 directing the owner/occupier to explain as to why the unauthorized construction shall not be removed within 7 days. No reply was submitted. Therefore, Speaking Order dated 23.08.2024 was passed by respondent No.4 directing owner/occupier to remove the deviated portion/unauthorized construction within 15 days and further forwarded the said Speaking Order to the Nodal Officer, City Planner, Uppal, Circle - 2, GHMC vide Letter dated 09.09.2024.

Learned Standing Counsel further submitted that presently, building is completed with Cellar + Ground + Five Floors + Pent House and GHMC is taking steps to issue vacate notice and also sealing notice to the present owner/occupier. It was found that after taking building permissions, Sri A. Bhaskar Reddy and Smt. Rajoli Veena Kumar sold the property to respondent No.5.

Considering that the Speaking Order dated 23.08.2024 has been passed and letter dated 09.09.2024 has been addressed by respondent No.4 to the Nodal Officer, City Planner, Uppal, Circle - 2, GHMC to implement the speaking order, this Writ Petition is disposed of directing respondent No.4 to implement the Speaking Order dated 23.08.2024, within a period of four (04) weeks from the date of receipt of a copy of this order. As the order is passed without entering into merits of the case, notice to respondent No.5 is dispensed with. However, if respondent No.5 is having any grievance, he is at liberty to seek modification of this order.
As a sequel thereto, miscellaneous applications, if any pending, in this petition, shall stand closed. There shall be no order as to costs.
