IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE P.SAM KOSHY
Aditya Vikarm Vyas – Appellant
Versus
Suresh Vyas @ Suresh Kumar Vyas – Respondent
CRP 1884/2025
THE HONOURABLE SRI JUSTICE P. SAM KOSHY Civil Revision Petition Nos.1884 & 1961 of 2025
COMMON ORDER :
Heard Mr.P.Ram Chander, learned counsel representing Mr.P.Raj Kiran, learned counsel for the petitioner and Mr.B.Dharma Teja, learned counsel representing Mr.R.A.Achuthanand, learned counsel for the respondent Nos.2 to 4. Perused the material available on record.
2. The present is an offshoot of earlier Civil Revision Petition i.e., C.R.P.No.514 of 2024 which stood decided on 22.03.2024.
3. Earlier, C.R.P.No.514 of 2024 was allowed by this Bench permitting the four civil suits i.e., three suits for partition i.e., O.S.Nos.161 of 2017, 187 of 2017 and O.S.No.68 of 2023 along with a suit for dissolution of partnership i.e., O.S.No.81 of 2017 to be clubbed together as all the suits were in respect of the same suit schedule property and between the same parties on either side. The said C.R.P. stood allowed on 22.03.2024.
4. However today, when these matters are taken up, it has been informed that the learned trial court till date has not been able to club all the suits and take up for a joint trial and is still proceeding
independently in all the four suits and therefore, the instant revision petition has been filed.
5. Mr. Mr.B.Dharma Teja, learned counsel entered appearance on behalf of the respondent Nos.2 to 4 and submits that so far as clubbing all the three suits of partition i.e., O.S.Nos.161 of 2017, 187 of 2017 and O.S.No.68 of 2023 being clubbed together as ordered by this Court earlier, he does not have any objection. Nonetheless, he states that the fourth suit i.e., O.S.No.81 of 2017 being a suit for dissolution of partnership that would requires a separate set of evidence and contentions hence may not be clubbed and it can be taken up separately.
6. The said contention of the learned counsel appearing for the respondents is not objectionable to the counsel for the petitioner herein. He further submits that atleast the other three suits for partition may be clubbed and ordered to be taken up together.
7. Given the said submission made by the learned counsel for the parties on either side, in slight modification to the order passed in C.R.P.No.514 of 2024, decided on 22.03.2024, this Court orders that let the three suits of partition i.e., O.S.Nos.161 of 2017, 187 of 2017 and O.S.No.68 of 2023 be clubbed together and the trial court is directed to proceed and conduct joint trial for the three partition suits and proceed appropriately by deciding the same as expeditiously as possible. However, as regards the fourth suit i.e., O.S.No.81 of 2023 i.e., suit for dissolution of partnership, the same may be taken up independently and the same may be decided in the course of the evidence that the parties would be leading in the said suit.
8. Let the order passed in the present C.R.Ps., be made part of the record of C.R.P.No.514 of 2024.
9. With the aforesaid direction, this civil revision petitions stand allowed. No order as to costs.
As a sequel, miscellaneous applications pending if any, shall stand closed.
