THE HON’BLE SMT. JUSTICE TIRUMALA DEVI EADA CRIMINAL PETITION No.11512 OF 2025

ORDER:

This Criminal Petition is filed by the petitioner – accused No.1 seeking to quash the proceedings in C.C.No.2380 of 2023 on the file of the learned VII Additional Judicial Magistrate of First Class, Medchal, registered for the offences under Sections 419, 420, 468, 471 and 109 of the Indian Penal Code (for short “IPC”).

2. Heard the submissions of N. Hari Prasad, learned counsel for the petitioner and the Sri Jithender Rao Veeramalla, learned Additional Public Prosecutor for respondent No.1 – State.

The learned petitioner counsel has submitted that the petitioner herein is facing false allegations in the hands of the de- facto complainant and that the de-facto complainant has executed AGPA in favour of the petitioner 25 years ago and now he raised such allegations that he has impersonated the respondent No.2 which is utterly false and that the cause is invented just to harass the petitioner herein to settle the scores in civil disputes. He therefore, prayed to quash the proceedings against the petitioner.

The learned Additional Public Prosecutor has submitted that the respondent No.2 is a native of Chittoor, taking advantage of his absence in the locality, the petitioner has impersonated the de-facto complainant representing himself as N.R.Gopal Naidu, has received the amount under the award passed by the L.A.O in land acquisition proceedings which was acquired for ORR and that the investigation further revealed that the petitioner has signed the document in Telugu as N.R Gopal Naidu, but however the respondent No.2-N.R Gopal Naidu affixes his signature in English. Therefore, he prayed to dismiss the petition.

5. Perused the record.

6. The contents of the charge sheet points out the allegations under Sections 419, 420, 468, 471 and 109 of IPC. Though the petitioner alleges that there is an agreement of sale-cum GPA executed in his favour by the de-facto complainant, he has not filed the said copy before this Court. The AGPA filed as a part of the material papers shows that it is executed by N.R Gopal Naidu in favour of one MHV Gopala Krishnam Raju on 08.01.2004 and the said document is signed by N.R Gopal Naidu in Telugu. It is pertinent to observe here that the petitioner’s name is P. Vijay Bhaskar Reddy, however, he failed to file any AGPA in his favour.

7. The respondent No.2 has lodged a private complaint in the Court of XXIII Metropolitan Magistrate and he has signed in English. The truth or otherwise in the allegations and the strength of documents are to be tested during the course of trial. Hence, the petitioner is not entitled to any relief, as the petition lacks merits.

8. In the result, the Criminal Petition is dismissed.

Miscellaneous applications pending, if any, shall stand closed.
