ORDER:

Heard Mr. J.R.Manohar, learned counsel for the petitioner, Mr. A.Raghuram, learned Assistant Government Pleader for State of Andhra Pradesh appears for respondent Nos.1 and 2, Mr. S.Suman, learned Government Pleader for Services-III appears for respondent Nos.3 and 4 and Mr. B.Mukherjee, learned counsel for respondent No.5.

The grievance of the petitioner, who is working as a Joint Director, District Insurance Office, is that the respondent- Government of Andhra Pradesh has not yet called for options from the employees for allotment between the two States pursuant to the bifurcation of parent State of Andhra Pradesh. Consequently, persons like the petitioner are being denied promotion to higher cadres. Therefore, the petitioner has prayed for a direction upon the 1^st respondent i.e., the State of Andhra Pradesh to call for options from the Assistant Directors based on the Seniority List dated 23.12.2022 and allot them between the State of Telangana and State of Andhra Pradesh as per the directions of this Court vide order dated 01.04.2021 in W.P.Nos.9784 of 2019 and batch cases.

Both the learned counsel for the petitioner and the learned Assistant Government Pleader for State of Andhra Pradesh have brought to the notice of this Court that a modification has been made in the order dated 01.04.2021 rendered by this Court in W.P.Nos.9784 of 2019 and batch vide order dated 02.09.2025 passed in I.A.No.1 of 2023 in W.P.No.10100 of 2019 and I.A.No.1 of 2023 in W.P.No.10386 of 2019 preferred by the State of Andhra Pradesh. It is submitted that the effective date for preparation of the Seniority List in the parent State of Andhra Pradesh is to be treated as 01.06.2014 instead of 02.06.2014 since the State got divided on 02.06.2014. Pursuant to the modification, the Directorate of Insurance, Government of Andhra Pradesh has issued an order appointing a Nodal Officer for uploading the required material i.e., revised Seniority List of Assistant Directors of Insurance in Form-III on the A.P. Reorganization Website and to maintain liaison with the G.A (SR) Department in the process of allocation. It is submitted that the Nodal Officer would facilitate the exercise of finalisation of the Seniority List as on 01.06.2014 on the basis of which allocation of the officers to the two States and their seniority in the respective newly born States are to be finalised for the purposes of promotion to the higher posts.

Learned counsel for the petitioner submits that in that light, the writ petition may be disposed of directing respondent No.1 to call for options from the cadre of Assistant Director to which the petitioner belongs on the issue of finalization of Seniority List and allot them between the State of Telangana and State of Andhra Pradesh.

In the light of the aforesaid facts and circumstances and the exercise underway, we deem it proper to dispose of the writ petition with an observation that respondent No.1 and its authorities would endeavour to conclude the exercise of preparation of the Seniority List and further actions as contemplated in the order dated 01.04.2021 rendered by this Court in W.P.Nos.9784 of 2019 and batch and modification made in the said order vide order dated 02.09.2025 passed in I.A.No.1 of 2023 in W.P.No.10100 of 2019 and I.A.No.1 of 2023 in W.P.No.10386 of 2019, in accordance with law, in the time frame prescribed under the said order.

6. The instant Writ Petition is, accordingly, disposed of.

However, there shall be no order as to costs.

Miscellaneous applications pending, if any, shall stand closed.
