THE HONOURABLE SRI JUSTICE N. TUKARAMJI WRIT PETITION No.25515 of 2016

ORDER:

This writ petition is filed under Article 226 of Constitution of India seeking the following relief/s: “…to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the respondent No.6 in not investigating into Crime No. 352/2015 and same has been transfer to S.R.Nagar Police Station in Crime. No. 867/2015 though registered on 21-07-2015 as wholly illegal, arbitrary, and consequently directs the 6th respondent to proceed with the investigation into Crime No. 352/2015 and same has been transfer to S.R.Nagar Police Station in Crime.No. 867/2015 and to file the charge sheet before the concerned Magistrate, and to grant such other relief or reliefs as this Honble Court deems fit and proper in the circumstances of the case.....”

2. None appeared on behalf of the petitioner.

3. I have heard Mr.R.Laxmikanth Reddy, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 6.

4. Learned Assistant Government Pleader for Home would submit that upon transfer of crime, basing on the petitioner’s representation, Narsingi Police Station, renumbered it as Crime No.352 of 2015. After due investigation, final report was filed endorsing “undetected” on 30.03.2017 on the file of the III Additional Metropolitan Magistrate, Hyderabad. Therefore, the contest raised in the petition does not survive.

5. I have perused the materials on record.

Having regard to the development reported by the learned Assistant Government Pleader for Home and the contention of the petitioner that the respondent police authorities had not investigated into crime has been effectively addressed, this Court is of the view that, nothing further survives for adjudication. Accordingly, this petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous petitions, petitions if any, shall stand closed.
