THE HONOURABLE SRI JUSTICE N.TUKARAMJI WRIT PETITION No.36612 OF 2018

O R D E R:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-

“…to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 2 to 7 in interfering with the construction of Compound Wall as being made by the petitioner across his land admeasuring Ac.26.00 guntas in Survey No.1007 of Kukatpally Village and Mandal, Medchal Malkajgiri District as arbitrary, high handed, capricious and opposed to Article 300A of Constitution of India and Section 432 of GHMC.Act,1955 with a consequential direction against the respondents not to cause any interference for the proposed construction of Compound Wall as undertaken by the petitioner under the deemed sanction of the provisions of GHMC Act,1955 and to pass..….”

2. Heard Mr.Palle Sriharinath, learned counsel representing Mr.M.Parma Reddy, learned counsel for the petitioner and Mr.R.Laxmikanth Reddy, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 3.

Learned counsel for the petitioner would submit that as the respondent Nos.2 to 7 are interfering with the construction of compound wall though there was favourable direction by competent Civil Court in favour of the petitioner. He further submits that, his application for construction of compound wall has been kept pending by the concerned Municipal Authority. However, the interference by the respondent Nos.2 to 7 without any lawful basis is not proper, hence, prayed for appropriate directions.

4. Learned Assistant Government Pleader for Home would submit that, there was no interference as contested by the petitioner and the police authorities are strictly abiding by law and the procedures prescribed.

5. Having regard to this position, and the prayer of the petition that, respondent Nos.2 to 7 are interfering with the construction of compound wall which is apparently civil matter, the respondent Nos.2 to 7 are hereby directed not to interfere with any civil disputes between the petitioner and unofficial respondent, save and except, in strict accordance with law.

6. With this direction, this writ petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
