THE HONOURABLE SMT. JUSTICE K. SUJANA CIVIL REVISION PETITION No.2653 of 2025

ORDER:

Heard Sri S. Chandrasekhar, learned counsel for the revision petitioner and heard learned counsel for respondent.

2. Learned counsel for the revision petitioner submitted that respondent filed a false and vexatious criminal case against the revision petitioner and intending to encroach the land of the revision petitioner, therefore the revision petitioner filed an Injunction Suit vide Case No.A4/CPC/866/2023 before the learned Additional Agent to Government and Project Officer, ITDA Utnoor (Agency Court), because the said land is situated at agency area. It is further submitted that the revision petitioner obtained interim status quo order on 19.8.2023 in the said Injunction Suit. It is further submitted that respondent filed counter in injunction petition and written statement in main case. It is further submitted that the Agency Court i.e. Additional Agent to Govt.-cum-Project Officer, ITDA Utnoor, again passed ad-interim injunction order in favour of revision petitioner restraining the respondent their family members, agents, henchmen from entering and interfering over the suit land till 20.7.2024, passing an order in I.A. No.2 of 2024 in Case No.A4/CPC/866/2023.

3. It is further submitted that this Court in C.R.P.No.1959 of 2024 dated: 23.08.2024 said that in according to Telangana Agency Rule, the Addl. Agent-cum-Project Officer, ITDA Utnoor got no powers to constitute agency court. It is directed to the Addl. Agent to Govt.-cum-Project Officer ITDA Utnoor to transfer all cases to the District Collector, who is the competent authority to constitute agency court. It is further submitted that, thereafter, the Addl. Agent to Govt.-cum- Project Officer ITDA Utnoor is not deciding any civil suits by constituting agency court. It is further submitted that, inspite of the direction, the Addl. Agent to Govt. cum Project Officer ITDA Utnoor neither transferring the cases nor taking up the cases. As such, requested for necessary direction.

4. In view of the above submissions and the material available on record, this Civil Revision Petition is disposed of directing the Addl. Agent to Govt.-cum-Project Officer ITDA Utnoor to transfer all the cases forthwith to the Agents to Government/District Collectors in view of the orders passed by this Court in C.R.P.No.1959 of 2024 dated: 23.08.2024, within one (01) month from the date of receipt of a copy of this order.

There shall be no order as to costs As a sequel, miscellaneous petitions pending, if any, shall stand closed.
