Order:

This Civil Revision Petition has been filed invoking the provisions under Article 227 of the Constitution of India aggrieved by the order dated 08.04.2025 passed by the learned Sub- Divisional Magistrate and Special Assistant Agent to Government, Mobile Court at Bhadrachalam, in I.A. No.177 of 2013 in O.S. No.250 of 2013, where under temporary injunction granted on

23.11.2013 is made absolute.

2. Heard Mr. N.Ramu, learned counsel, representing Mr.Syamala Ravinder Reddy, learned counsel for the petitioners and Mr.Azar, learned counsel, representing Mr. B.Sandeep Kumar, learned counsel for respondent No.2.

3. Learned counsel for the petitioners submitted that the learned Sub-Divisional Magistrate without considering the contentions of the petitioners made the temporary injunction granted on 23.11.2013 as absolute, without giving any reasons much less valid reasons and the impugned order dated

08.04.2025 passed by the Court below is contrary to law.

Per contra, learned counsel for respondent No.2 submitted that the learned Sub-Divisional Magistrate after considering the contentions of both the parties and after due verification of the documents filed by the respondents rightly passed the impugned order. Hence, there are no grounds to interfere with the said order.

Having considered the rival submissions made by the respective parties and after perusal of the material available on record, it reveals that the respondents/plaintiffs have filed suit in O.S.No.250 of 2013 for grant of perpetual injunction. Along with the said suit, respondents filed I.A. No.177 of 2013 under Rule 42(C) of the A.P. (T.G.) Agency Rules, 1924 r/w Order XXXIX, Rules 1 and 2 of C.P.C. and the Court below granted temporary injunction on 23.11.2013 and the said order is made absolute on

08.04.2025.

6. It is pertinent to mention that the nature of suit filed by the respondents/plaintiffs is a simple suit for perpetual injunction and the same is pending since more than 12 years. Hence, this Court is of the considered view that while exercising the supervisory powers conferred under Article 227 of the Constitution of India, directing the learned Sub-Divisional Magistrate and Special Assistant Agent to Government, Mobile Court, Bhadrachalam, to dispose of the main suit in O.S.No.250 of 2013 as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order in accordance with law. Till such time, both the parties are directed to maintain ‘status quo’ in respect of the petition schedule property in I.A.No.177 of 2013 as on today. The parties are directed to cooperate with the Court below for disposal of the suit without seeking any undue adjournments.

6. With the above said direction, the Civil Revision Petition is disposed of accordingly. There shall be no order as to costs. As a sequel, miscellaneous petitions, pending if any, stand closed.
