WP 19615/2025
HON’BLE SRI JUSTICE K. LAKSHMAN WRIT PETITION No.19615 OF 2025

In compliance with order dated 09.07.2025, learned counsel for the petitioner filed proof of service of notice on respondent Nos.7 and 8 vide U.S.R.No.73242 of 2025, dated 12.09.2025. Despite service of notice, there is no representation on behalf of respondent Nos.7 and 8.
2. Heard learned counsel for the petitioner and Ms.Tekuru Swetcha, learned Assistant Government Pleader for Revenue.
3. Petitioner is claiming that he is the absolute owner and possessor of land admeasuring Acs.25.10 guntas in Sy.Nos.110/AA, 79, 109, 100 and 117, situated Chada Village, Motakondur Mandal, Yadadri Bhuvangiri District, basing on the unregistered partition deed, dated 11.06.1999. Even then, respondent Nos.7 and 8 obtained mutation proceedings and pattadar passbook in respect of the land admeasuring Acs.5.00 guntas in Sy.No.100, situated at Chada Village, Motakondur Mandal, Yadadri Bhuvangiri District, by way of misrepresentation. Therefore, he has submitted a representation dated 03.09.2018 to respondent No.6 with a request to implement the unregistered partition deed, dated 11.06.1999. Despite receiving and acknowledging the said representation, respondent No.6 did not act upon the same. He has also submitted representations dated 05.12.2021, 06.05.2024 and 19.05.2025 to respondent Nos.4 to 6 with similar request. The same were not considered. Therefore, challenging the said inaction of respondent Nos.2 to 6, petitioner filed the present writ petition.
4. Though the petitioner is claiming the right over the subject property basing on the unregistered partition deed, dated 11.06.1999, he has submitted the said representation on 03.09.2018 to respondent No.6 with a request to implement the said unregistered partition deed, dated 11.06.1999. There is no explanation much less the plausible explanation for the abnormal delay in submitting the representation to respondent No.6.
5. During the pendency of the said representations, State has promulgated the Telangana Bhu Bharati (Record of Rights in Land) Act, 2025 (for short ‘Act, 2025’), which came into effect from 14.04.2025. The Telangana Bhu Bharati (Record of Rights in Land) Rules, 2025 (for short ‘Rules, 2025’) were also framed vide G.O.Ms.No.39, Revenue (Land Administration–I) Department, dated 14.04.2025. It is for the Competent Authority to consider the same.
6. In the light of the said discussion, notice to respondent Nos.7 and 8 is dispensed with. This Writ Petition is disposed of granting liberty to the petitioner to submit online application, along with all the relevant documents, to the Competent Authority. On receipt of the said online application, Competent Authority shall consider and dispose of the same, in accordance with law, by putting the petitioner, respondent Nos.7 and 8 and all interested parties on notice and affording them an opportunity. In the circumstances of the case, there shall be no order as to costs.
