ORDER :

The present writ petition is filed by the petitioner under Article

226 of the Constitution of India seeking issuance of writ of mandamus to direct the 7th respondent to dispose of the case pending before him in respect of Sy.No.212/B-1, admeasuring Ac.0.24 Gts., situated at Dharmapuram Village, Dharmasagar Mandal, Hanumakonda District (erstwhile Warangal Urban District) by deciding payment of compensation payable to the petitioner.

Heard Sri Y.Koteswara Rao, learned counsel for the petitioner and Sri Hingolekar Rakesh Kumar, learned Assistant Government Pleader appearing on behalf of learned Government Pleader for Revenue Sri K.Muralidhar Reddy. Though Sri B.Vikram, learned counsel is on record for the respondent Nos.5 and 6, today none appeared on their behalf.

The case of the petitioner is that the petitioner is in possession of the land in Sy.No.212/B-1, admeasuring Ac.0.24 gts., at Dharmapuram Village, Dharmasagar Mandal since 1978 by virtue of a Sadabainama and his name was included in revenue records until 2015, but it was deliberately omitted thereafter due to the interference of respondent Nos.5 and 6. Though the land was acquired in 2016 for the Uppugallu Reservoir Project, compensation has not been paid for Sy.No.212/B-1 due to objections raised by respondents Nos.5 and 6, who possess no valid documents. The petitioner, despite multiple representations, has not been granted relief. As there is no alternative remedy and in view of the continued inaction of respondent No.4 despite binding directions, the petitioner prays that this Court may direct early disposal of his case and grant appropriate relief.

The learned counsel for the petitioner submits that since the subject matter of payment of compensation for acquisition of lands was transferred to the respondent No.7 by the State, the petitioner by filing IA No.1 of 2025 got impleaded the 7th respondent to the proceedings of the present writ petition and subsequently, as per orders in IA No.2 of 2025 necessary amendments to the prayer portion of the writ petitioner have been carried out.

5. Learned counsel for the petitioner further submits that the petitioner is the rightful owner of land in Sy.Nos.212/B1 and 212/B2 of Dharmapuram Village, acquired through inheritance and purchase. His name was recorded in the pattadar and occupation columns of the revenue records from 1993–94 to 2010–11, but was inexplicably removed thereafter. Despite submitting multiple representations to the Tahsildar, Dharmasagar and reminder by the Revenue Divisional Officer, Warangal Urban vide letter No.A/4722/2017, dated

10.11.2017, no corrective action was taken. Meanwhile, the respondents, who have no valid title or documents, allegedly secured entries in their favour and were recommended for land acquisition compensation, which the appellant contends is unlawful. Therefore, the petitioner preferred appeal vide Rc.No.A/2153/2018 under Section 5(B) and 5(5) of AP Rights in Land and Pattedar Passbooks Act, 1971 seeking a direction to record his name in the patta and occupation columns. Wherein, the unofficial respondents remained absent and the said appeal was disposed of by the 3^rd respondent on 07.01.2020 directing the 4^th respondent to conduct denova enquiry in the subject matter, issuing notices to both the parties and conduct panchanama with help of neighbouring farmers and take action as per ROR Act and Rules, as the lands were acquired under land acquisition proceedings. Inspite of lapse of substantial time and despite several visits of the petitioner requesting the 4^th respondent to conduct enquiry, as ordered by the 3rd respondent, the 4th respondent did not initiate steps resulting in the petitioner to deprive of compensation from the land acquisition officer.
