THE HON’BLE SRI JUSTICE K.SARATH WRIT PETITION No.26036 of 2025

ORDER:

Heard learned Senior Counsel appearing for the petitioners and learned Assistant Government Pleader for Endowments appearing for the respondent Nos.1 to 4, learned Standing Counsel appearing for the respondent No.5 and learned counsel for the respondent Nos.6 to 7 and perused the material on record.

This writ petition is filed to declare the proceedings in Rc.No.A4/4184/2019 dated 24.07.2025 issued by the respondent No.3 as illegal and arbitrary, consequently, set aside the same while directing the respondent authorities to restore and maintain the petitioners status as member of the founder family in the Register maintained under Section 43(10) of Telangana Charitable and Hindu Religious Institutions and Endowments Act, 1987.

After hearing both sides and on perusing the entire material available on record, this Court is of the considered view that the respondent No.3 passed order on 04.04.2025 in Rc.No.A4/4184/2019 with a finding that the writ petitioners along with the respondent Nos.6 and 7 are recognized as Founder Family Members fixing Rotation among them for the term of one year, which is contrary to the earlier order dated 16.07.1993 in O.A.No.8 of 1993 passed by the respondent No.3-Deputy Commissioner of Endowments wherein it is stated that father of the petitioners is the Founder Member of the subject temple. Aggrieved by the order dated 04.04.2025, respondent No.6 made a representation to respondent No.2-Commissioner, Endowments Department and the same was forwarded to respondent No.3-Deputy Commissioner, Endowments Department, Hyderabad to pass appropriate orders in the subject matter. On receipt of the said communication, respondent No.3 cancelled the order dated 04.04.2025 and passed the present impugned order dated 24.07.2025 vide Rc.No.A4/4184/2019, without hearing the writ petitioner, and directed respondent No.4- Assistant Commissioner, Endowments Department, Ranga Reddy, to take necessary action in the matter. 4. Admittedly, both the orders dated 04.04.2025 and 24.07.2025 were passed by the respondent No.3- Deputy Commissioner, Endowments Department, Hyderabad, without hearing the affected parties. However, after arguing for some time, both the learned counsel for the contesting parties requested this Court to grant permission to approach respondent No.3 to redress their grievances by making appropriate representations/

applications.

In view of above circumstances, this Writ Petition is disposed of by setting aside the orders dated 04.04.2025 in Rc.No.A4/4184/2019 and 24.07.2025 in Rc.No.A4/4184/2019 passed by the respondent No.3 and directing the respondent authorities to conduct enquiry by giving opportunity to interested parties including personal hearing of the petitioner as well as respondent Nos.6 and 7 and pass appropriate orders, strictly in accordance with law, as expeditiously as possible, preferably within a period of eight (08) weeks from the date of receipt of a copy of this order and communicate the same to the both sides. However, after communication of the said order, the aggrieved party therein is at liberty to avail remedies in accordance with law.
