IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE N.TUKARAMJI
Ch. Pavitra Kumar – Appellant
Versus
The State of Telangana – Respondent
WP 14314/2017
THE HONOURABLE SRI JUSTICE N.TUKARAMJI WRIT PETITION No.14314 OF 2017
O R D E R:
This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-
“…pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the 2nd respondent in sending the police constables to the petitioners residence and calling him to the police station, in relation to FIR.No. 123/2017, though his name does not find place in the said FIR and thereby causing interference with his personal life and liberty, as being illegal, arbitrary and unconstitutional and consequently direct the 2nd respondent not to call the petitioner to the police station or in any manner interfere with his personal life and liberty, and to pass such other order or orders as this Honbie Court may deem fit and proper in the circumstances of the case and in the interest of justice....….”
2. None appeared on behalf of the petitioner.
3. I have heard Mr.R.Laxmikanth Reddy, learned Assistant Government Pleader for Home appearing for respondent Nos.1 and 2.
4. Learned Assistant Government Pleader for Home submitted that, as the police report indicated the involvement of other in Crime No.123 of 2017. Upon due investigation, the petitioner was arrayed as an accused, and a charge sheet was filed. The Court concerned has taken cognizance of the offence, and the case has been numbered as C.C. No.1962 of 2020 on the file of the Judicial Magistrate of First Class, Kodad. The matter is presently at the summons stage, and summons have been served on the petitioner, directing his appearance on 06.10.2025. In view of these developments, dismissal of the writ petition was prayed for.
5. I have perused the materials placed on record.
6. The contention of the petitioner is that he was being called to the police station without any reason. However, in Crime No.123 of 2017, it has been clarified by the respondent/police that the investigation revealed the petitioner’s involvement in the offence, pursuant to which charge-sheet proceedings have been initiated, and the matter is now pending before the trial Court.
respondent/police is found to be without basis.
7. Further, in light of the subsequent developments, namely, that the petitioner has already been arrayed as an accused and trial proceedings are underway before the competent Court, it is apparent that the prayer seeking a direction not to call the petitioner to the police station has become infructuous.
8. Accordingly, this writ petition is dismissed as infructuous.
There shall be no order as to costs.
Miscellaneous Petitions, pending if any, shall stand closed.
