THE HON’BLE SRI JUSTICE PULLA KARTHIK WRIT PETITION No.27015 OF 2025

ORDER:

Aggrieved by the inaction of the respondents in passing final orders on the representation of the petitioner dated 13.05.2025, the present Writ Petition is filed.

2. Heard Sri C. Raja Shekar Reddy, learned counsel for the petitioner, and learned Government Pleader for Services-I, appearing on behalf of the respondents. With their consent, the writ petition is taken up for disposal at admission stage.

Learned counsel for the petitioner submits that while the petitioner was working as Assistant Programme Officer in the office of respondent No.3, proceedings dated 11.02.2025 were issued, posting one Mrs. Pratapa Saritha, Secondary Grade Teacher (Telugu), in an existing vacancy at M.P.P.S., Asaravelly, Nallabelli Mandal, Warangal District, on spouse grounds. However, the said individual did not join duty. Thereafter, one Mrs. V. Padma, Secondary Grade Teacher (Telugu) was transferred and posted at M.P.P.S., Rudragudem, Nallabelli Mandal, on 23.01.2025. However, to the utter shock and surprise of the petitioner, for the reasons best known to him, respondent No.3 issued proceedings dated 11.02.2025, transferring and posting the petitioner as Secondary Grade Teacher (Telugu) at M.P.P.S., Asaravelly, Nallabelli Mandal, Warangal District, and the aforesaid Smt. V. Padma was posted as Assistant Programme Officer in the office of respondent No.3 on 11.02.2025. However, she had requested to modify her posting orders and in pursuance thereof, she was posted at M.P.P.S., Cherlaparthy, Duggondi Mandal, vide proceedings dated 23.04.2025. As such, the original place of posting of the petitioner, i.e., office of respondent No.3, has fallen vacant. Therefore, the petitioner submitted his representation to respondent No.2 on 07.04.2025, requesting to continue him as Assistant Programme Officer in the office of respondent No.3. In pursuance of the same, respondent No.2 issued proceedings Rc.No.680/Ser.III-1/2025 dated 15.05.2025, requesting respondent No.3 to examine the issue and to take necessary action in the matter, as per the Rules in force. However, no action has been taken thereon so far. Therefore, learned counsel prays this Court to direct respondent No.3 to take a decision in the matter, by passing necessary orders on the letter addressed by respondent No.2 vide Rc.No.680/Ser.III-1/2025 dated 15.05.2025, at the earliest.

4. Learned Government Pleader for Services-I, appearing on behalf of the respondents, submits that a ban on transfers is in subsistence. However, it is fairly submitted that respondent No.3 will take an appropriate decision in the matter by passing appropriate orders on the letter addressed by respondent No.2 vide Rc.No.680/Ser.III-1/2025 dated 15.05.2025, in accordance with law.

Having regard to the submissions made by learned counsel for the respective parties, without expressing any opinion on merits of the case, this Writ Petition is disposed of directing respondent No.3 to take a decision in the matter by passing appropriate orders on the letter addressed by respondent No.2 vide Rc.No.680/Ser.III- 1/2025, dated 15.05.2025, strictly in accordance with law, as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of a copy of this order, and communicate a copy thereof to the petitioner.

Miscellaneous petitions, pending, if any, shall stand closed.

There shall be no order as to costs. ______________________________
