HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.26585 OF 2025 ORDER : (ORAL)

This writ petition is filed by the petitioner seeking to declare the action of respondents No.2 to 5 in not taking action against the illegal and unauthorized construction comprising of cellar + 6 upper floors being carried out by respondent No.6 in premises bearing H.Nos.8-4-481/7, 481/10, 481/11, 481/12, 8-4-518, 8-4-519, Erragadda, Hyderabad, as against the sanctioned plan for construction of stilt + 3 upper floors, as being illegal, arbitrary and unconstitutional.

2. Heard Mr. Satish Kumar, learned counsel for the petitioner; Mr. G.Madhusudan Reddy, learned Standing Counsel for GHMC, appearing for respondents No.2 to 5; and perused the material on record.

3. The petitioner lodged complaint dated 12.12.2024 with the respondent authorities requesting them to take action against respondent No.6 for making unauthorized construction in premises bearing H.Nos.8-4-481/7, 481/10, 481/11, 481/12, 8-4-518, 8-4-519, Erragadda, Hyderabad. The grievance of the petitioner is that so far, his complaint is not being considered and no action has been initiated, as such, he is constrained to approach this Court.

4. Learned Standing Counsel for GHMC submitted that appropriate action will be taken on the complaint of the petitioner dated 12.12.2024 in accordance with law.

Recording the aforesaid submission,, this writ petition is disposed of directing respondent No.5 to forward the complaint of the petitioner dated 12.12.2024 to the Deputy Commissioner, Circle- 19, GHMC, Yousufguda, to take action against respondent No.6 with regard to the illegal construction, by affording opportunity of hearing to the petitioner and respondent No.6, and pass orders in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.

6. As order is passed without entering into the merits of the case, notice to respondent No.6 is dispensed with. However, respondent No.6 is, in any way, aggrieved by this order, he is at liberty to approach this Court seeking modification of this order. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in this writ petition stand closed.
