HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.26545 OF 2025 ORDER : (ORAL)

This writ petition is filed by the petitioner seeking to declare the action of the respondent authorities in not acting upon her representation dated 22.05.2025 with regard to illegal and unauthorized construction made by respondents No.4 and 5 comprising of 3rd, 4th and 5th floors in premises bearing H.No.15-27-1008, LIG, (GHMC Door No.15-27-1008), situated at KPHB Phase-I and II, Kukatpally, Hyderabad, in deviation of the building permission vide permission dated 05.10.2023, as being illegal, arbitrary and unconstitutional.

2. Heard Mr. Pallerlamudi Suresh, learned counsel for the petitioner; Mr. K.Ravi Mahender, learned Standing Counsel for GHMC, appearing for respondents No.2 and 3; and perused the material on record.

Learned Standing Counsel for GHMC submitted that on complaint of the petitioner, action was initiated and show cause notice under Sections 452(1) and 461(1) of the Greater Hyderabad Municipal Corporation Act, 1955 dated 31.12.2024 was issued to respondents No.4 and 5. However, respondents No.4 and 5 have not submitted any reply.

Thereafter, speaking order dated 17.01.2025 was passed for removal of unauthorized construction raised by respondents No.4 and 5 in premises bearing H.No.15-27-1008, LIG, (GHMC Door No.15-27-1008), situated at KPHB Phase-I and II, Kukatpally, Hyderabad. It is further submitted that respondent No.3 addressed letter dated 03.02.2025 to the Nodal Officer, SPF (Special Task Force), Kukatpally Zone, GHMC to take necessary action for demolishing the unauthorized construction made in the above said premises.

4. In view of the above, no further orders are required to be passed. This writ petition is disposed of directing respondent No.3 to ensure implementation of the speaking order dated 17.01.2025 as expeditiously as possible preferably within a period of four (4) weeks from the date of receipt of a copy of this order.

5. Notice to respondents No.4 and 5 is dispensed with. However, if respondents No.4 and 5, in any way, aggrieved by this order, they are at liberty to approach this Court seeking modification of this order. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in this writ petition stand closed.
