ORDER
The Writ Petition is filed challenging the action of respondents No.4, 6 and 7 in trying to confiscate and shift the CMR paddy stock available with the petitioner, despite the fact that two separate enquiries are pending before respondents No.4 and 5 with regard to the alleged shortfall of CMR paddy and the cutoff date for delivery of CMR rice under the Custom Milling Agreement is
30.09.2025, as illegal and arbitrary.
2. Learned counsel for the petitioner submitted that during Rabi 2022-23, the petitioner was supplied with CMR paddy of more than its capacity and that due to the heavy rains, some of the stock got damaged and therefore, the petitioner and also other rice millers in the area had made representation to respondent No.4 requesting to consider the damage caused to them and to determine the shortfall thereafter. It is submitted that the petitioner had replied to all the show cause notices issued by the respondents, however, without considering the same, the respondents have issued the proceedings dated 28.08.2025 taking the stock of the petitioner into safe custody.
