ORDER

This writ petition is filed seeking following prayer:-

“to issue an appropriate Writ or direction more particularly one in the nature of a Writ of Mandamus declaring the action of Respondent Nos.2 to 5 in failing to act on the representation given by the Petitioner dated 11.08.2025 regarding the illegal eviction of the Petitioner from the property bearing H.No.10-24-50 Deendar Anjuman, Asif Nagar, Hyderabad at the instance of Respondent No.8 with the aid and assistance of Respondent Nos.6 and 7 and their officers as arbitrary, illegal and violative of Articles 14, 21 and 300A of the Constitution of India and consequently direct Respondent Nos.2 to 5 to take appropriate action on the said representation dated 11.08.2025 within a fixed time frame.”

The petitioner claims that her husband by name Mohammed Naseeruddin is the lawful possessor of H.No.10-2-450, admeasuring 200 square yards situated at Deendar Anjuman, Asif Nagar, Hyderabad (hereinafter referred as ‘the subject property’). The said property formed part and parcel of Deendar Saheb Khibla, established by Hazrath Moulana Syed Siddique Deendar Saheb Khibla, in a single compound to preach Islam. The petitioner’s husband constructed residential units for the residence of his disciples and for the residence of preachers of Islam, and her husband is one of the preachers of Islam. Since 2006, the petitioner along with her husband and children are residing in the subject property without any interruption from anyone.

It is submitted that respondent No.8 without having any right or interest over the subject property, on 14.07.2025, at around 12:00 P.M., along with Respondent No. 7 and some officers of Respondent No. 6, came to the subject property and forcefully evicted the petitioner and her family members. Respondent No. 7 and the officers of respondent No. 6 forcefully entered the house and threw away the household articles and handed over possession of the subject property to respondent No. 8. The said fact was immediately informed to respondent No.6, but there was no response. The petitioner suspects that respondent Nos. 6 and 7 have colluded with respondent No. 8 and conspired to evict the petitioner and her family members from the subject property for the purpose of handing over the possession to respondent No.8. Thereafter, questioning the said illegalities, the petitioner made a representation dated 11.08.2025 to respondent Nos. 2 to 5, requesting to take appropriate action against respondent No.7 and the other officers of respondent No. 6, who are involved in the said eviction. In the representation, copies of the photographs have been filed to show the involvement of the police officials. Though the said representation was given on 11.08.2025, no action has been taken by respondent Nos.2 to 4. Questioning the same, the present writ petition is filed.

4. Sri M. Srinivas, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 6, placed instructions of Sub-Inspector of Police, Mehdipatnam Police Station, Hyderabad, wherein it is stated that the petitioner has given a petition to the Deputy Commissioner of Police, Hyderabad on 11.08.2025 vide Inward No.5799. The Deputy Commissioner of Police, South West Zone, Hyderabad, forwarded the same to the ACP, Asif Nagar Division, South West Zone, Hyderabad vide Memo dated 12.08.2025, and the same was forwarded to respondent No.6 for enquiry and necessary action. Thereafter, respondent No.6 enquired into the allegations made by the petitioner and submitted a report on 23.08.2025 to the Deputy Commissioner of Police, Hyderabad.
