O R D E R :

This Criminal Petition is filed under Section 482 of Cr.P.C. by the petitioner-accused No.1 seeking to quash the proceedings against him in C.C.No.256 of 2021 on the file of the learned Judicial First Class Magistrate at Alampur, Jogulamba-Gadwal District, registered for the offences under Sections 447, 427 and 506 read with Section 34 of the Indian Penal Code (for short ‘IPC’).

2. Heard Mrs. Y.Ratna Prabha, learned counsel for the petitioner and Mr. M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for respondent No.1-State. Inspite of service of notice, there is no representation for respondent No.2-de facto complainant. Perused the record.

The facts of the case, in brief, are that the de facto complainant, LW-2/K.Sreeramulu and LW-3/Mahammad Gouse are the absolute owners and possessors of agricultural land admeasuring Ac.6.29 gts. in Sy.No.117 (hereinafter referred to as ‘subject land’).
