Aggrieved by the interim order dated 26.08.2025 passed in W.P.No.25527 of 2025 by the learned Single Judge, the present Writ Appeal is filed.
2. Heard Sri P. Chidambaram, learned Senior Counsel representing Sri Sricharan Telaprolu, learned counsel appearing for the appellant and Sri Sridhar Reddy, learned Standing Counsel appearing for the respondents.
3. Learned Senior Counsel appearing for the appellant had contended that the appellant is a Company which had entered into High Tension Agreement with respondent No.2 for power supply. Learned Senior Counsel had further contended that the Andhra Pradesh Electricity Regulatory Commission (APERC) vide its order, dated 21.09.2005 in O.P.No.16 of 2005, prescribed the methodology for calculating the Cross Subsidy Surcharge (CSS) for financial year 2005-06. Despite the same, respondent No.2 and other Distribution Companies (DISCOMS) in the State raised demands for payment of CSS from the Scheduled Consumers of generators authorized under Section 43(A) (1)
