THE HON’BLE SRI JUSTICE N.V.SHRAVAN KUMAR Writ Petition No.26500 of 2025 This writ petition is filed seeking the following prayer:

“…challenging the inaction of the Official Respondent Nos.2 to 4 in not considering the Petitioner representation Dt.07.06.2025 in providing Police Protection as per the directions passed on 18.10.2024 in I.A.No.387 of 2022 to implement the injunction Orders passed in I.A.No.244 of 2022 in O.S.No.150 of 2022 on the file of Honourable Junior Civil Judge, Tandur with regards to petitioner’s property admeasuring 606 Sq.Yards, Plot Nos.16, 17 and 18 in Sy.No.58/2, situated at Malreddypally Village, Tandur Mandal, Vikarabad District (‘subject property’ hereinafter) as illegal, arbitrary and Violation of Article 14 of Constitution of India…”

2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing on behalf of respondents. With their consent, this writ petition is taken up for disposal.

The facts of the case in brief as stated are that petitioner claims to be absolute owner of subject property having purchased the same under registered sale deed in Doc.No.1251/2018 dated 03.03.2018 registered before Sub-Registrar Office, Tandur. It is submitted that some persons claiming through unofficial respondent Nos.5 and 6 started interfering with the peaceful possession of the petitioner. Accordingly, petitioner filed a suit in O.S.No.150 of 2022 for permanent injunction on the file of Junior Civil Judge, Tandur. In the said suit, petitioner has filed an I.A.No.244 of 2022 for grant of temporary injunction. The trial Court on 22.04.2022 granted temporary injunction restraining unofficial respondents from interfering with the peaceful possession of the petitioner, till pending disposal of main suit. It is submitted that as the unofficial respondents are not implementing the injunction order, petitioner moved I.A.No.387 of 2022 seeking police protection for implementation of injunction order. The trial Court was pleased to grant police protection by its order dated 18.10.2024, to the petitioner in enforcing the injunction order. As the official respondents are not providing police protection, the petitioner herein made several representations to respondent Nos.2 to 4 seeking police protection. One such recent representation dated

07.08.2025 was acknowledged by respondent Police but failed to accord police protection. Questioning the same, the present writ petition is filed.

4. Learned Assistant Government Pleader for Home, on instructions would submit that if the representation of the petitioner dated 07.08.2025 is still pending for consideration, appropriate orders be passed to that effect.

5. Recording the submissions of learned counsel on either side, this writ petition is disposed of with a direction to respondent authorities to implement the orders of the trial Court in I.A.No.387 of 2022 in I.A.No.244 of 2022 in O.S.No.150 of 2022 on the file of Junior Civil Judge, Tandur and also consider the representation of the petitioner dated 07.08.2025 in accordance to law.

Miscellaneous petitions, pending, if any, shall stand closed. However, there shall be no order as to costs.
