THE HON’BLE SRI JUSTICE N.V.SHRAVAN KUMAR Writ Petition No.25571 of 2025 This writ petition is filed seeking the following prayer:

“…to declare the action of the Respondent No.1 in not registering the FIR in pursuant to the Complaint dated 11.04.2025 made by the petitioner even inspite of the contents of the complaint clearly disclose the commission of cognizable offence by the Respondent No.4 as arbitrary, illegal and contrary to Section 173 of BNSS and consequently direct Respondent No.1 to register the FIR in pursuant to complaint dated 11.04.2025 made by the Petitioner against the Respondent No.4 and conduct the investigation in accordance with law…”

2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing on behalf of respondent Nos.1 to 3. With their consent, this writ petition is taken up for disposal. Notice to respondent No.4 is dispensed with.

The facts of the case in brief are that respondent No.4 induced the petitioner to sign on the document and obtained signatures on the guise of GPA and the petitioner signed on the said document which was a sale deed executed on 14.08.2024 in favour of respondent No.4. Thereafter, petitioner came to know that respondent No.4 deceived the petitioner and fabricated the documents creating the rights over the property. Subsequently, petitioner gave a complaint on 11.04.2025 narrating all the incidents. However, till date, the respondent/Police have neither registered FIR nor made any enquiry against respondent No.4. Questioning the same, the present writ petition is filed.

The Sub-Inspector of Police, LMD Colony Police Station has placed a copy of instructions through learned Assistant Government Pleader for Home stating that basing on the petitioner’s complaint dated 11.04.2025, respondent No.1 has made GD entry and pursuant to the enquiry it is revealed that the dispute between the petitioner and respondent No.4 is with regard to the land of Ashram situated at Reddy Colony, Kothapally Village, Thimmapur Mandal, Karimnagar District. Respondent No.4 got executed a sale deed in his favour and now both the petitioner and respondent No.4 are claiming rights over the property, which is purely civil in nature. As such the complaint given by the petitioner was ‘closed as civil in nature’ on 14.04.2025 and the same was informed to the petitioner. However, the petitioner filed the present writ petition alleging that respondent No.1/Police have not taken action on his compliant.

5. In that view of the matter, since the property has been sold in the year 2024 and the complaint of the petitioner has been closed as civil in nature, the petitioner may avail appropriate remedy as available under law. 6. With the above observations, this writ petition is disposed of.

Miscellaneous petitions, pending, if any, shall stand closed. However, there shall be no order as to costs.
