IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE N.TUKARAMJI
Kambalapally Srinivas Reddy – Appellant
Versus
The State of Telangana – Respondent
WP 7233/2017

THE HONOURABLE SRI JUSTICE N.TUKARAMJI WRIT PETITION No.7233 OF 2017

O R D E R:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:- “…to issue an appropriate Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondent No.4 herein in conducting investigation into FIR No.164/2016 though the said case is registered on 13.10.2016 as being illegal, arbitrary and unconstitutional and consequently direct the respondents herein to complete the investigation and file final report before the concerned Magistrate as expeditiously as possible and to grant such other relief or reliefs ….”

2. Heard Mr.J.Janaki Rami Reddy, learned counsel for the petitioner and Mr.R.Laxmikanth Reddy, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4.

3. Learned counsel for the petitioner submitted that, as the respondent police failed to proceed with the investigation in Crime No.164 of 2016, the present writ petition has been filed seeking appropriate directions.

4. Learned Assistant Government Pleader for Home submitted that, upon registration of the crime, proper investigation was conducted. After consideration of the material collected, proposals were submitted to the Sub- Divisional Police Officer, Kalwakurthy Sub-Division, Nagarkurnool District, on 14.02.2017 seeking permission to refer the case as “false.” Permission was accordingly accorded on 23.02.2017, and thereafter the final report was filed before the concerned Court. Hence, it was contended that the cause in this writ petition no longer survives for adjudication.

5. Having regard to the contentions raised in the writ petition and in view of the fact that the final report has already been filed before the competent Court, this Court is of the considered opinion that the grievance of the petitioner stands effectively redressed. Consequently, the cause in this writ petition has become infructuous. However, the rights of the petitioner are reserved to avail appropriate remedies before the concerned Court, in accordance with law.

6. Accordingly, this petition is dismissed as infructuous.

There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
