THE HON’BLE SRI JUSTICE NAMAVARAPU RAJESHWAR RAO WRIT PETITION No.17975 of 2009

ORDER

The present Writ Petition is filed to declare the action of respondents in not regularizing the services of the petitioner as Lecturer in Commerce, as illegal.

2. Heard Sri Ravi Kondaveeti, learned counsel for the petitioner, learned Government Pleader for Higher Education, appearing for respondents No.1,2,4 and 5 and Sri B. Vivek Jain, learned counsel for respondent No.3.

Learned counsel for the petitioner submits that petitioner made an application for appointment to the post of Lecturer in Commerce and was selected by a Selection Committee and posted as a Junior Lecturer in sanctioned aided post in D.R. Goenka College for Women, Tadepalligudem, and petitioner joined on 08.08.1980 and worked there up to 1986.

4. Learned counsel for the petitioner further submits that later, petitioner was posted as a Junior Lecturer in Commerce in G.L.R. New Model Junior College, Dilsukhnagar, Hyderabad and permitted to work as a Lecturer in Commerce from 01.08.1988 to 30.04.1990. Thereafter, petitioner was posted as Part-time Lecturer in Commerce in the Sarojini Naidu Vanita Maha Vidyalaya College of Women, Hyderabad, in the year 1990, and again subjected him to attend interview before a Selection Committee (consisting of University representatives), with a oral promise that he would be absorbed in a regular vacancy.

5. Learned counsel for the petitioner further submits that the Government issued orders in G.O. Ms.No.328, Education (C.E.III) Department, dated 15-10-1997 for regularization of services of Part-time Lecturers and Part-time Junior Lecturers working in Private Aided Degree/Private Aided Junior Colleges.

Learned counsel for the petitioner further submits that as per the above said G.O., the petitioner is fully eligible and qualified for regularization of services and fulfilled all the conditions stipulated in the above G.O. Therefore, the 3^rd respondent submitted a proposal for regularization of petitioner’s services to the 2^nd respondent, vide Ref. No. SNVMV/95/2002-2003, dated 27.5.2002 in the existing vacancy and the same was acknowledged by the 2^nd respondent on 30.05.2002, but till date no action has been taken by the 2^nd respondent. Therefore, sought a direction to the respondent authorities to consider the case of the petitioner for regularization of his services.

7. Learned counsel for the respondents though filed counter, did not discuss anything with regard to the proposal sent by the 3^rd respondent to the 2^nd respondent.

8. Though the proposals for regularization were received by the 2nd respondent on 30.05.2002, no action has been taken by the 2^nd respondent till today. In the circumstances, this Court, without expressing any opinion on the merits of the case, direct the 2^nd respondent to consider the proposal sent by the 3^rd respondent Ref.No.SNVMV/95/2002-2003, dated 27.05.2002 for regularization of the petitioner’s services as Lecturer in Commerce and pass appropriate orders, in accordance with law, if he is otherwise eligible, within a period of eight (08)

weeks from the date of receipt of a copy of this order.

9. With the above direction, this Writ Petition is disposed of.

There shall be no order as to costs.

Miscellaneous applications, if any pending, shall also stand closed.
