ORDER

This Criminal Petition has been filed by the petitioner/accused seeking to quash the proceedings in Crime No.99 of 2019 on the file of Cyer Crime police station, Cyberabad registered for the offences punishable under Section 406 of IPC and Section 66(D) of Information Technology Act, 2000.

2. Heard Ms. Visista, learned Counsel representing Mr. GVL Murthy, learned Counsel for the petitioner, Ms. Dr. J. Vijayalakshmi, learned Counsel appearing on behalf of the respondent No.1 and Mr. M. Vivekananda Reddy, learned Assistant Public Prosecutor appearing on behalf of respondent No.2.

During the course of hearing, learned Additional Public Prosecutor basing on the instructions furnished by the concerned S.H.O. submitted that during the pendency of the Criminal Petition, the investigation officer after conducting investigation filed charge sheet before the IX Additional Metropolitan Magistrate, Cyberabad, Kukatpally, Ranga Reddy District and the said Court taken the cognizance and the same was numbered as C.C. No.764 of 2024 and by virtue of the same, the cause in the present Criminal Petition does not surviv
