THE HONOURABLE SMT. JUSTICE K. SUJANA CIVIL REVISION PETITION No.2815 of 2025

ORDER:

Challenging the order dated 18.06.2025 passed in I.A.No.189 of 2024 in O.S.No.11 of 2022 by the learned Junior Civil Judge, Bhainsa, the present Civil Revision Petition is filed.

2. The brief facts of the case are that the defendants forfeited her right to file a written statement on 19.07.2022. She later filed the present petition on 21.02.2024, seeking to set aside the ex-parte order stating that she is 70 years old, unable to attend court, and suffering from age-related ailments. At the time of filing, the suit was already at the stage of the plaintiff’s further evidence. The trial Court found these reasons insufficient and noted that there was a delay of nearly three years in filing the petition and dismissed the petition. Aggrieved thereby, the revision petitioners filed the present Civil Revision Petition.

3. Heard Smt. T.S.R. Praneetha, learned counsel appearing on behalf of the petitioners.
