THE HON’BLE SMT. JUSTICE T. MADHAVI DEVI WRIT PETITION No.20303 OF 2025

ORDER:

This Writ Petition is filed declaring the action of the respondents No.1 to 3 in appointing Non-Official Persons as In Charge Committee of 4^th respondent-Karimnagar Cooperative Urban Bank Limited, Karimnagar under Section 32(7)(a)(ii) of the Telangana State Cooperative Act, 1964 (for short ‘the Act’) and in extending the term of Non-Official Persons In Charge Committee from time to time and for further period of six (06) months by its order dated 23.06.2025 vide G.O.Ms.No.285, Agricultural and Cooperation (COOP-II) Department, as illegal and arbitrary.

Heard learned counsel for the petitioner, learned Government Pleader for Cooperation, appearing for respondents No.1 to 3, Sri K.Vasudeva Reddy, learned counsel appearing for respondent No.4 and Ms.Pratusha Boppanna, learned counsel representing Mr.Nalin Kumar, learned counsel appearing for respondent No.5-

Reserve Bank of India.

Learned counsel appearing for the petitioner submitted that accordance with the provisions of the Act and is also not acting in transparent and fair manner, therefore, the petitioner is seeking appointment of Persons In Charge Committee by the officials of the Department till the elections are held for the Managing Committee.

Learned counsel appearing for the 4^th respondent-Karimnagar Cooperative Urban Bank Limited, Karimnagar submitted that the process for conducting elections has been initiated and voters list is also finalized. He further submitted that pursuant to the direction of this Court in W.P.No.19460 of 2025, dated 15.07.2025, Elections will be held very soon. The allegation of mis-management and not conducting affairs of the Society in a fair and transparent manner are not correct and substantiated.

5. Learned Government Pleader appearing for Cooperation has produced written instructions received by him, according to which the voters list has already been prepared but due to some discrepancies in the same, the proposals were returned vide letter dated 25.06.2025.

After hearing all the parties, this Court finds that there is no provision under the Act to appoint only official persons as the Persons In Charge of the Cooperative Banks or any other Society. if the petitioner has any grievance against functioning of the said Committee, he can always make a representation to the Registrar of

the Cooperative Societies who shall look into the same.

Though learned counsel for the petitioner has filed additional material papers along with the Memo dated 12.08.2025, this Court is not in a position to decide whether the activities being carried on by the Non Official Persons In Charge Committee are in accordance with the provisions of the Act, as they require verification of facts. The grievance of the petitioner against the Non Official Persons In Charge Committee can be looked into by the Registrar of Co- operative Societies. Therefore, this Court is not inclined to interfere with the appointment of Non Official Persons as In Charge Committee of the 4^th respondent at this stage. Therefore, without going into the merits of the case and with liberty to the petitioner to approach the Registrar, the respondents are directed to proceed with the Elections as directed by this Court in W.P.No.19460 of

2025.

8. With the above direction, the Writ Petition is disposed of.

There shall be no order as to costs.

9. Miscellaneous applications, if any, pending in this writ petition stand closed.
