HON’BLE SRI JUSTICE LAXMI NARAYANA ALISHETTY WRIT PETITION No.21495 of 2023

ORDER:

This writ petition is filed to declare the action of respondent No.3 in not considering the representation dated 16.06.2023 filed by petitioner No.1 for mutation of her name in revenue records in respect of the land admeasuring Ac.1-05 gts in Sy.No.558/14, situated at Peddamangalaram Moinabad Mandal, R.R.District, as illegal and arbitrary.

2. Heard Sri Srinivas Pendota, learned Counsel for the petitioners and learned Assistant Government Pleader for Revenue.

Learned Counsel for the petitioners would submit that originally, the husband of the petitioner No.1 was the absolute owner and possessor of the agricultural land measuring an extent of Ac.1-05 gts in Sy.No.558/14, situated at Peddamangalaram Mandal, R.R.District and his name was also reflected in the Pahanies for the year 2010-11, 2016-17, 2020- 2021 and till today. He further submitted that husband of petitioner No.1 died on 27.02.2017, leaving behind petitioner No.1 and her daughter i.e., petitioner No.2 as legal heirs.

16.06.2023, before respondent No.3 along with copies of Pahanies for the year 2010-11, 2016-17 and 2020-21, Xerox copy of death certificate, Family member certificate and Aadhar Card, with a request to mutate her name. Despite receiving and acknowledging the said application, respondent Nos.3 did not act upon the same, therefore, the present Writ Petition.

4. The learned Assistant Government Pleader for Revenue, on instructions would submit that 3rd respondent will consider the application submitted by petitioner No.1 and pass appropriate orders in accordance with law, if reasonable time is granted.

It is relevant to note that the State of Telangana has promulgated the Telangana Bhu Bharati (Record of Rights in Land), Act, 2025 (Act No.1 of 2025) in place of Telangana Rights in Land and Pattadar Pass Book Act, 2020 (Act No.9 of 2020) by simplifying procedure for mutation/alteration of entries in revenue records and created Bhu Bharati Portal, through which online application can be submitted for alteration/mutation of entries, etc., 6. In view of above, this Writ Petition is disposed of with a per the prescribed format through Bhu Bharati Portal for mutation of her name in revenue records. On such application being submitted, respondent No.3 is directed to consider the same and pass appropriate orders strictly in accordance with law within a period of two months thereof, by duly issuing notice to the petitioners as well as all affected parties and also affording them an opportunity of hearing. If, the respondent No.3 is not inclined to accept the request made by the petitioners, he shall assign specific reasons and pass a reasoned order, communicate copy of the said order to the petitioners.

There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
