THE HONOURABLE SRI JUSTICE N.TUKARAMJI CRIMINAL PETITION No. 9958 OF 2025
ORDER:
This petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking to set aside the order dated 09.07.2024 in Crl.M.P.No.62 of 2023 in M.C.No.4 of 2023, on the file of learned Judicial magistrate of First Class at Dubbak, against the petitioner.
2. Heard Mr.K.Rajashekar, learned counsel for petitioner, Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No.1-State.
3. The petitioner is arrayed as respondent in Crl.M.P.No.62 of 2023 in M.C.No.4 of 2023, filed by the respondent Nos.2 and 3 herein under Section 125(1) of Cr.P.C before the trial Court maintenance of an amount of Rs.20,000/- per month each to respondent Nos.2 and 3 herein.
4. On 09.07.2024, the trial Court partly allowed the petition Rs.10,000/- per month to respondent Nos.2 and 3 from the date of petition and to be paid on or before 10th day of every month and the arrears in twelve monthly equal installments and Rs.2,000/- to respondent Nos.2 and 3 towards the costs of the petition. Challenging the said impugned order, the petitioner herein filed the present criminal petition.

At hearing, learned counsel for petitioner restricted his prayer for a direction to the trial Court for expeditious disposal of the Maintenance Case as the maintenance case is pending for enquiry and after passing the impugned order there is no progress in the matter and this portion is causing severe inconvenience to the petitioner.
6. Considering the submissions of leaned counsel for petitioner, the inconvenience stated by the parties and also the fact that the Maintenance Case is of the year 2023, the trial Court is directed to prioritize the matter and dispose of the matter at an earliest point of time preferably within six (06)
months from the date of next adjournment.
7. With the above direction, this Criminal Petition is disposed of.
Pending miscellaneous applications, if any, shall stand closed.
